Don't even call and complain to the bank. Call the police and declare it stolen. Also be sure to notify your insurance company. Point is you know where it is. You know its yours. The bank screwed up big time, and the more noise you can make about it the easier its going to make it for someone to lose their job, and for you to be properly reimbursed for your time. Make sure you mention lawsuit at least twice in the same sentence, and that your invalid wife whom you care for solely is going to have to go without medicine for a week because you couldn't get to work.;)

They made the last payment, bank sent the title and everything. And somehow there was $75 outstanding on the thing and Honda american finance sent the repo dude. They showed him the title and the letter stating it was paid in full and he left it. The guy was way cool. He knew it was their only car.

Before they repo the vehicle the repo company will usually turn in a form to the local police department informing them of the intention to reposess (that way they do not get stolen vehicle reports for repo'd vehicles).
More than likely you will need to settle the issue with the bank & then take your paperwork to the tow yard & settle the towing/storage fees with them. To get your money back, you'll probably have to sue the bank. Good luck. Also, don't delay in case they took it directly to the auction lot...
It cost me over $1000 when the bank incorrectly repo'd my truck. It turned out the copies of insurance were misfiled & they showed that I owed $$ for the insurance they put up to cover the truck (incorrectly thought I was behind on my payments). Took me several days (@ $65 / day storage) to get it all straightened out. $400 towing fee, 5 days at $65 ea, plus a few other "filing fees". Also, required a trip to the police dept to get the repo filing taken off (and more $$).

Similar thing happened to me. I got the payoff amount and sent it in, got the title in a few weeks. Soon after, I get a deliquent payment call for $325 and I explain the situation with an agreement they would take care of it. A couple of years later I am refinancing my house and it is on the credit report as a write off. I call them again and explain it again with yet another promis to "take care of it".

It is still there and we continue to go through this about every month or so. I don't even have the car anymore...:rolleyes:

I had a similar issue with insurance. The bank waived full coverage insurance on 2 auto loans. They sent threatening letters both times saying I’m in violation of the insurance requirement. I told them send the tow truck, and get your lawyers ready. I’m looking at my paper work and the box that says waive insurance is checked and signed by your loan officer. The second time they called again – I told them the same thing.

If it was an original $40.00 bill, then why didn't they notify him right away? Further, since it was obviously the bank's error, since he has the title, why are they even suggesting that he pay late charges, interest, etc.

I added to my post after I finished reading the thread. My problem with it is that people do make mistakes and should be given a chance to fix them and be stand up business people before getting in their face. Ive made mistakes at work and Im sure everyone else on here has as well. after reading the rest I saw that they chose not to play nice so I agree with everyone elses opinion, I just think they were premature in their judgements.

It sounds like the bank is practicing to be the IRS. If any of my past creditors did something like this to me. I would stick it in them and break it off.

The IRS is the only entity I know that can get away with "Well we noticed you screwed up 4.99 years ago...So get out the check book and bend over.

Even if there was a screw up and let's take the case that maybe there was $40 left unpaid. THEY RELEASED THE FRIGGIN TITLE? Wouldn't they have to simply consider it as "oh well" someon screwed up in the company and now they just have to eat it? HE HAS THE TITLE and they are the ones that gave it to him! That's like paying for something at the checkout, then when you get home from the grocer someone comes knockin and says, "excuse me sir, we screwed up and didn't charge you enough for that donut you're eating. Got a call from the bank, says I am two months late and they will repossess the car.
I ask what months I am late for, she tells me.
I the say "So you are telling me I am late for payments 51 and 52 on a 48 Month car loan?" Answer "Yes"
"well then why did you give me the title when I paid it off four months ago?"
"You better send me the title back"

"NO"

Two more months and we were in court, me with 48 cancelled checks, the bank didn't even show up.

I went back and read one of his posts on page 2
he says I was $40 dollars short of compete payoff when they released the lien (interest on principle) and that late fees and interest charges have pushed that up to $3000! and it reads like they are charging him interest on interest? :confused:

I knew a guy that shot and killed a repo man and was no-billed after he showed the judge the title and paperwork showing it was paid for, same deal, the bank was claiming he still owed 450....he woke up a 5AM to some noise, went out front with the /357 and the guy told him he could do nothing to stop him from taking his car, he pulled the trigger. Then called the cops and clained that some guy was trying to steal his car...went to jail for a couple days, then bailed out and went to court...the bank had to pau for all of it, PLUS the judge ordered the bank to pay $6000 to him for mental anguish...a month later the widow sued the bank and won a buttload of money....

if you'll notice I didnt reply to that thread. If it was my kid i wouldnt have busted the windshield but he would haave felt the heat

I wish I was. This is serious. Apparently he took a swing at the banker. He couldnt get ahold of the wife so he called me so I could let her know whats going on in case he cant get another call. He goes before the judge on monday and hopefully will get released on bail. I thik I fucked up by saying HE called and not his wife, hopefully this will correct any doubts and at least one or two people will believe

Finaly I find the deposit receipt, oh now they have it. But they dont want to refund the money for the bounced checks.....

I didnt hit anyone but of the 30+ people in line not a one of them had a single doubt as to why I was pissed, or what the bank was doing to me. I hope I got a few people to close their account that day, I sure did....

I've yet to hear anything good about BoA.

About 6 or so years ago, I ordered a sandwich at mcdonalds, the clerck palmed the check and "washed" it, rewriting it to herself for $300. it bounced. I was with Wells Fargo at the time, they covered the check, but I got a bounce fee. add in some other small purchaes I made, un aware of my account's true status, and I had close to a grand in bounced checks.

the girl was caught, so they knew what happened, but they refused to remove any of the bounced check fees. I ended up filing suit over it, and threatening to goto the local "scam buster" on the news with it, and they suddenly felt it would be a good idea to credit me back the fees, so it never reached court.

I walked the paper into my branch, went home, and had a message on the machine saying it had been taken care of. some people work fast with the right engouragement.

promptly closed my account and I haven't use a bank since. I only deal with credit unions now
