Well, I'm back. I am am SOOOOOOOOOOOO Glad to be home. As Paul Harvey says, here's....the rest of the story.I can't believe this went that far, I take a couple of days off for spring break and the damn thread goes to 8 pages LOL!!
I went to the bank. I calmly walked up to the teller and asked to see the highest ranking person in the joint (just to keep from telling the same story 15 times to 15 different people) She, a fairly good looking woman in her mid 20's asked me why I told her that I had my jeep repossesed by the bank the day before and I was here with my title and lien release to straighten it out. (I said this all as calmly and consisely as I could) She said just a moment and brought out her manager (an older dude with a bald head). I explained to him what had happened and he said he would go get a loan officer, I said "aren't you the person in charge?" He said no. I asked the teller how much cow shit she had in her ears! She was taken aback a little and said "none, why?" I said I had clearly stated that I wanted to talk to the head nigger in charge so that I didn't have my time wasted. (this time I was a bit firmer If you can imagine that) Anyway the next person that came out of the back was an even older white guy, I assumed this was the big cheese so I started my schpeel again. He said come into his office. We walk in and there is already a person sitting in one of his seats, it's my original loan officer who I signed the loan with. I say "just the person I want to see" and tell them I want my jeep back in my driveway by the close of business or I will go to the police and file auto theft charges on them. They start in with thier yammering and hum hawing and I say "listen, I'm not interested in excuses or reasons or anything else than YES SIR! YOUR JEEP WILL BE BACK IN YOUR DRIVEWAY BY THE END OF THE DAY" By this time I am getting loud and I mean LOUD, Barney Fife is already looking at us and slowly walking my way. Then the suit says "you will not recieve your jeep unless you pay us the $3000. I say "Fine, I'm not only gonna file criminal charges I'm gonna file civil charges for missed work and THEN I'm gonna take an ad out in the paper and tell the world that your bank likes to steal cars from it's customers. Well I guess barney didn't like that, he pipes up and tells me that I need to leave. I tell barney he needs to go fuck himself. So on that note everyone stands up, so I stand up, Mr. bank manager tells me that if I don't leave now that he'll call the cops, I say go right ahead, that'll give me the chance to file the theft charges. They dial the popo and all the while I'm ranting like a wet hen. I'm telling them that I'll see to it that they are all out of a job and they will be sleeping in the streets, eating leftovers from the trash and drinking hot monkey urine before I'm through with them.
SOOO johnny law shows up and asks me to step outside, I tell them that I will only leave when I have my jeep back. NOPE, I get carried outside by two ugly motherfuckers who want to use my head as a bongo. When we get to the jail I buck again. So now I have the two original dickheads on me and three more rent-a-cops on me from the jail. Now I have Criminal Tresspass, Resisting arrest, and Assault charges on me. I spent the night in jail with some cockeyed drunk who kept asking me for a smoke. I keep telling him I don't smoke but he keeps bugging me so I pulled off one of his shoes and his socks and stuffed it in his mouth. That finally shut him up!
I went to the arraignment and told the judge what happened at the bank . He said he wasn't interested in the semantics he just wanted to know If I was pleading guilty or not guilty. I said, "100% NOT guilty" So my bail is set at $2000 full cash and Mindy gets me out, I go to get my stuff, Guess what, the JAILER just so happened to have MISPLACED my title and lien release when I was booked. I hope to God I can find copies of those damn things at home. SO I have a court date May fifth. I'm gonna get a lawyer and I'm gonna put the screws to these assholes. Or I'm gonna be royally fucked and you guys will have to send me a PM with a file in it!let's see how many fish this one nets :blackevil:

tresspassing for staying there after they had told me to leave, assault for giving one of the jailers a bloody lip.
They said the original 40 bucks was an unpaid late fee in Jan of 2001. The interest on that late fee and charges for repoing the truck added up to the 3k. When I got home I got my cancelled check and it was cashed on the due date of my payment. I am gonna hammer them or burn down the bank one or the other.

I don't know about these fuckers, I SAW them put all my stuff (walet, keys, papers, etc) in the envelope when I was booked. When I was released the title and lien release was not in there. I was about to throw another fit but Mindy was there and she kept me from going back in.

JSA, you should be able to file a loss title. Go to the title office and tell them you lost your title. Catch is, it will probably take at least a month. Sorry the bank and now the cops are being so rediculous! :eek: We should come up with a special advatar for the gulible ones who fall for this! :blackflipoff2:

Won't matter - w/o the lein release, he's F'd. If it's anything like MN, the Title will still have the Bank's name on it until it's transferred by the owner and DMV w/ a lein release...

Not sure about the lien release, but I walked in and paid eight dollars to get a replacement title printed up for me a week ago. A month would be rediculous.

That is total BS there. How convenient for the bank. Sounds almost like someone at the bank has a local cop in their pocket. If you didn't actually touch anyone that is nothing short of rediculous that they actually took you to jail and booked you.
You are probably screwed on the loan release, but you can get a copy of the title from the DMV. I'm not certain, but wouldn't the bank have notified the DMV when they released the title to you? If so, then the DMV will have a record that the title was turned over to you. I think that it works something like that here in PA, but it might vary from state to state.

yup, that's the way, I have a title with my name on it as the owner, the bank is the lienholder, I HAD the lien release that said it was paid for and the bank had no further money in it but that is gone and the only way I can get another one is FROM THE BANK:rolleyes:

Anyway sorry to hear you had such a crappyass week. As for the assault charge you should probably handle it carefully. I once got charged with assaulting an officer because I put my hand out to block him from coming into a party, and somehow the jury found me guilty. :rolleyes: Apparently any sort of contact can be considered assault.

Have your insurance agent call the bank and ask for a fax of the Lien release ASAP... tell the bank is to change the loss payee, or something.
I say your agent, because I doubt they'd give it to you now... Or... Send the bank a supaena for the lein release and all records notifying you of an overdue balance...

No offense, but I don't understand how you expected this to make the situation any better.
If you would have left right after the bank gave you trouble, and took your case to a lawyer would would probably have your truck back, and your lawyer fees.
And when the cops finally show up you brawl with them. If they are going to rough you don't fight back, it becomes your word against there then.
You could have had both the cops and the bank by the balls. I don't know who is screwing you more, the bank, the cops, or your attitude. :rolleyes:

When you were booked did they list the papers on your personal effects list?
While you may not have needed an attorney before, it sounds like you most certainly need one now! I completely understand you being pissed off, but not to the point of getting thrown in jail.
I agree with contacting your DMV and getting copies of your title. Although by now the bank has most likely already informed them of their mistake and that you still owe them $3000.00 :rolleyes:

I was royally pissed and this bum was making it worse. I could have just knocked him out but he quit just in time.

Yep, as I said in the original thread. They do inventory your stuff, and if I'm not mistaken, you have to sign the inventory sheet to verify that it's all listed. I think JSA went a little overboard with the e-drama! :D

Which is where he screwed up. If he didn't sit on his butt and got his title changed with the lien taken off, he could get a copy of the title...or get an original through the mail and this would solve EVERYTHING. I think your jailers suck ass. Diesel is right, every time I've been booked *ahem* I got to sit and watch them fill out an inventory list that I then initialed. Upon release the items returned are checked off the list and initialed again by me and I got a copy of that with my crap.
They never lost anything and I've gone through that BS more than a few times.:(

You don't need that letter! At this point of time its best just to call a good lawyer. But they send those letters to your insurance company, yourself, the department of motor vehicles. If you just get a copy of the title your case against the bank is good! As for you problem with the law your fucked per and simple. You may get a little simpthy from a jury but do not I repeat do not go to trial withouta lawyer. You sound just like me, You open your mouth before you think about your actions and get into some deep shit. But if you get a good lawyer you should have a good civil suit agianst the bank.

When I was tossed in the clink in Durango CO, they didn't inventory my stuff, and I didn't get it all back.
A nudie picture that was in my wallet was missing, and they ripped open the rubber that I had in my wallet.
My buddy that I was with claims that he was missing cash from his wallet, but he was so drunk that there is a good chance he had spent it all at the bar and just didn't remember it.
And that story is actually true!

OK, dumbass. I was talking about you stating "there is no fucking way i would have left without my papers. " When he tried that at the bank, he got his ass thrown in jail. Do you think if he tried it at the Jail, he'll get his ass thrown in Bank? Neither do I. :rolleyes:

Hate to say it but it sounds like what I have been going through for the past 6 months! Even after a good lawyer and lots of $ spent, I still do weekends at the local county jail! Trespasing, resisting arrest, disorderly conuct and harassment. All over walking over to knock on my neighbors door (who would not answer) and walking back to my driveway.
15 weekends!
And no I have not gotten any action in Jail, nor do I plan to!

JSA, I finally got the bank to fax over the papers this afternoon. Based on the published APR. compounding months and the timeline my attorney says that they are off by $372. Your paperwork for the arrest has not been processed yet. They said it should be ready by Wednesday or Thursday. I can pull it and let the attorney look at it. You are going to owe me for the free legal work. Oh and BTW I am told that depending on the Judge and how you look in court you may be spending time in jail for this one. Don't get your hair cut and see if you can grow a goatee. 3 of the possible judges don't like young punks. We need you to look as old as possible so they don't throw the book at you.
This is a RIOT. I had this pegged as BS from the start. Let's see how many suckers we can get to fall for this one. LOL

forget about the title, if he doesnt have the lien release he is screwed. first let me say they must be some greedy ass bankers or the bankers kid wanted your jeep because all of this is not worth a $40 late fee. im a loan officer and when you make a final payment and there is a late fee due the late fee still shows up in the pricipal balance so the loan doesnt show paid if you just made the regular payment. for $40 I usually just waive the fee and send the docs to paid out so you can get your paid note in the mail. now to get it up to 3k they must have some serious penaltys or the lawyer fee is included in that. thats just ridiculous.
now lets assume that they wanted to pursue this like a past due amt. they first would have contacted you I would think. god for $40 debit your account-if you had one there-and went on. but they would have had to send you a right to cure letter with a response date. if you did not meet the expectation of that first letter then they do not have to warn you again. they can pick it up anytime. if you did call or acknowledge the letter and didnt take care of the $$ they would have to had to send you a second 20 day notice or right to cure letter. after this it can be picked up at anytime if you do not comply. the only other way that they could have picked the jeep up is if they felt that their collateral was in danger which in this case is probably what happened.
ok here is what you need to be concerned with next. time has lapsed since they picked the jeep up. you have 10 days to pay it off or make arraingments with the bank to get your jeep back, im assuming that those days have passed so the jeep goes to the bank for repossession. now the only way for them to get a title to that is to file for a repossed title. now since your title and lien has dissapeared im assuming they gave it to the bank. you might be able to get a lawyer to bargan with them at this point. otherwise after the 30 day window the jeep is up for sale. most banks around here send them to auction because of ethical practice issues we have to get at least 3 different bids on the vehicle and instead of that headache we just send them to the auction block and or I have made arraingments with the owner to sell it for them and forgo the repo title.
I would get an attorney to stop the proceedings at the bank to tie up the jeep so it is not shipped off somewhere. until this is resolved.
again this is bs for a measly 40 late fee.
let me know if I can answer any other questions towards the banks actions from here out.

I've been sitting here mulling this over and have come to this conclusion.
You need a lawyer, keep one on retainer and let him talk to anyone who you are pissed at. Apparently your temperment is worse than mine and you have yet to learn when the shut the hell up and walk away to regroup for another attack. :rolleyes:
That being said here is what I would do now. In this order.
1) get a lawyer, his first step being a court order stopping the sale of your heep while this is pending.
2) contact your ins company and see if your state reports lein releases to them, if they do tell them you need a copy of the letter. Be nice, you draw more flies with honey than vineger.
3) contact DMV and ask the same questions.
4) contact the local sherriffs department and see what proof they need for a legal repo. In NC they need to provide a copy of the title showing the lein notarised as a "certified" copy. get a case number for your repo and give it to your lawyer.
5) this one is sketchy at best, go to the repo company and ask them about what they need to legally repo a car, do not tell them who you are. repeat do NOT tell them who you are. if the person you talk to seem receptive, breifly and POLITELY! explain what happened and ask them if you can have a copy of the repo order from the bank.
6) contact your states govorners citizens help line and ask them who is in charge of banking in your state. (in NC there is a banking commision) then contact them and see about filing a complaint. even with missing peices of the puzzle you might spark a investigation which might shake out the truth. banks are notoriously conservative and hate negative press.
7) speaking of press, call a local tv station and see if the have a consumer advocate person.
Now, I can not stress this enough. All the people you are talking to are being asked to do something FOR YOU! Therefore it is YOUR best interest to be nice....... repeat BE NICE and do not start slamming or insulting the bank. Look at it like this, you are being interviewed by a TV station on your problem. Think about how you will look to JQP on air. A genuine scared person in a bad situation or a drooling psycho? A kind, understanding, intelligent person or Charles Manson Jr? Get it? Comments about ass raping their dog, forking their neck, punting their ol ladies to the curb, skinning and eating their cat, selling their daughter to gypsy's etc.... will not win you favor, they just might get you in a clinic for a short stay while under some serious meds. If you go to court, win (long shot now, as fucked up as you've got this situation) and get whats rightfully yours take a piss in the fresh air intake of the bankers car or whatever, just get this handled first, then freak out. Remember, getting angry is a waste of time, getting even is good, getting ahead is better.

Well, after talking to the lawyer that MattS recommended, I may have some ground to stand on. He says that it's state law that the bank send the dmv the lien release too. So he called them and they have a copy. They've had it on file since it was paid off. I didn't have to do anything when I recieved it. If I had ever sold the jeep, it would have been in the computer that it had a clean title. I went to the dmv and they gave me a print out of all the vehicles I've owned, all the taxes I've paid on them AND thier lien status and it shows my jeep was free and clear. I'm gonna burn them a new one. YES!! I may be getting a few dollars from this one, If I do there's gonna be a BBQ at my joint. OH and MattS thanks buddy, I do owe you one. If you're ever in my neck of the woods, I'm buying you a seafood dinner my man. I've got a few on the stringer, we gonna have a fish fry! hehehe, I see a few of you got the "ebonics" joke!

That is excellent news. You will still have to deal with the legal issues of the trespassing/ resisting arrest etc... but as long as you have proof that the lien was removed you are in much better shape. Even if you do end up going to court over the incident, you will get much more sympathy from a jury since you can now prove that they did indeed steal your car without cause.

I agree 100%, they got what they deserved for stealing his Jeep. However, Johnny Law is going to see it differently. Regardless of why the incident happened (ie. their theft of his property) I am sure the cops are still going to attempt to prosecute the charges they filed since he gave them a hard time.
