: Who wants to play a game of F.O.P.V. ?

Since it looks like the Club comp is being postponed... it's been brought up about having some sort of bragging rights type thing at JV over Turkey Day.

PM if your interested in having some wheeling fun, pushing the limits of your rig, and will be out on the Lake Bed over Turkey Day weekend.

Regards

Dave

The Basics:

Think of it as a game of H O R S E (cept we're spelling FOPV ;) )

First guy calls a line and trys to score it. If he makes it, then everyone else makes an attempt. If you don't make it, you get a letter. Collect all the letters and you'll be spectating :)

It's all informal, and all for fun.

Bring it

Out of some of the people who have posted, including myself, maybe we should make up a new game...like who can stay un-broken the longest. Tim wouldn't last much beyond the lakebed before breaking an output shaft. JRT would get to the first waterfall, his eyes would roll back in his head like a great white on a feeding frenzie, and continue to beat the living hell out of D-Toys old rig until John shot him. And I would be stuck in some stupid, impossible line that would take a helicopter to get me out. That sound about right?

Why don't we race up Backdoor and let Mike kick our asses again?

FOPV has retained a premier real estate attorney from the Bay area. They have identified a couple of promising avenues to reopening. The last I heard, the attorney wanted 20k to file the case and he believed that it was quite possible that BLM would settle out of court. IF it did go to trial, it would require even more $$$. I have also heard that they (FOPV) has begun the grant writing process (to secuer other means of support). I know the TrailBlazers up in Bakersfield just did a big fund raiser as well.

Hopefully someone from 'in' FOPV will respond with some more detail.

There have been drag races on the lake bed !!!!!!! for trail rigs !---- night runs-- bout 1/8 mile,or less. start line is gas, lit on fire--- finish line is also fire line---- the starter vehicle is at the finish line-- parking lights on, get ready, headlight flash, GO !!!!!!!

1/8 mile means you can run in low range --4wd, or low/low/4wd-3-4-5th gears
two wheel drive usually means too much tire spin and a loss !! (for more challenge, start in a wet area, finish on dry !!!)

Tin Benders have a store of fun and games !!!!!!

run the 1/8 mile, stop get out and chugg a beer, get back in and 'u' turn race back to start line for the 'finish' !!!! (call that a "red neck" drag !!)

FOPV is working to open access on Surprise Canyon Road. The process includes a legal effort to challenge the 2001 closure order by the BLM (and subsequent restrictions imposed by Death Valley National Park).

The legal effort process includes a strict review of the actions of the BLM and DVNP, to identify where the actions conflict with the law (including the legal access prescribed in the passage of the Desert Protection Act and subsequent legal agreements entered into by the BLM).

The initial legal review has consumed well over $5000 dollars, and more work is being done to identify records relevant to the closure action (we do not want to reveal all aspects of research). The cost of the additonal research is unknown, although it is expected to equal that spent to date. In simple (and obvious) terms, the initial goal is to file a comprehensive legal complaint that the BLM abused their juristiction when they posted the closure order and when they ignored subsequent requests for legal access. The quality of the legal complaint is directly related to the quality of the research, identifying why the legal effort funding at this initial stage is critical (even if the reports of the effort can only be described in broad terms).

A complaint is not expected to open the road (unless the BLM is persuaded to respect the law through political pressure). The complaint will likely be followed with a restraining order and injunction to gain court direction, to order the BLM to open access on the road per the law established by Congress. Taking this process to a Federal Judge requires legal representation that has an assigned cost (and we are paying for what many believe is the best legal representation available).

The BLM's response to the complaint and injuction, challenging the court order, will determine if there is a need for a trial or a settlement. Both efforts (a trial or settlement) will require further legal representation to preserve the public rights of access on this historic road. It is not the intention to go to trial on this issue, although the effort will be taken to trial if required. If a settlement agreement is proposed by the BLM and DVNP, we do not want to be blindsided by legal terms and conditions imposed by these Agencies that are buried in an unreasonable settlement proposal (demanding legal council, and the respective cost of review and representation).

In all things legal the estimates of cost to mount a challenge are coached to be speculative. If the estimate is $20,000, expect the true costs to be $40,000 (etc.). The respect FOPV has for it's supporters includes a goal to not fail in this effort in the final stages of the effort in the event the BLM drags us into trial and funding is exhausted. We would rather have an excess of funds, than to run short of funds on the final obsticle.

While the FOPV effort is currently focused on reopening Surprise Canyon Road to the public, we also have parallel goals of improving public access to other parts of the mountain ranges surrounding the Panamint Valley. These parallel efforts will be executed with a combination of volunteer labor and funds collected (as allowed, so it will not dilute the legal effort to open Surprise Canyon Road). Any excess funds not applied to the current legal effort will be applied to other cooperative efforts to preserve motorized access to the rich recreation and cultural opportunities within this historic region.

I hope this helps others understand the ongoing effort and challenges, including the funding challenge. All funds advanced to FOPV are being directed to the legal effort to reopen access on Surprise Canyon Road.

Many clubs deserve thanks for their FOPV fundraising efforts and support (Trailblazers & Tinbenders included).

Happy Trails!

whyt
11-24-2004, 04:10 PM
Ed - good job of spelling out where FOPV stands thus far.

The legal portion of reopening Surprise Canyon Road is very complex, but a winnable fight, when done correctly.

Enough cannot be said about the clubs and individuals who have poured time and money into reopening the road.
