: Utah laws and out of state vehicles
Belly Dragger 02-19-2002, 06:32 PM Just so you guys know,
I've been making some headway with the Utah DMV regarding ticketing out of state vehicles for Utah specific registration laws. Basically I've researched the Utah Constitution, vehcile laws and Utah Vehicle Code and have found references to the fact that citing a non resident (Utah) for equipment violations such as fender, flares, mudflaps and lift is non-constitutional and there is provisions in the vehicle code that reference this specifically.
However as you and I know, it won't stop a cop from pulling you over but if you reference the vehicle code where it denotes that out of state vehicles are exempt most officers will say ok, thank you have a nice day. :D
But even further, there is an exempt status permit available from the DMV/Public Safety that is essentially a "get out of jail free" card!
I have requested mine, I'll let you know when I get it. When I do, I'll share with everyone as to how to get your own.
And yes, I'll be driving my completely Utah illegal junk to Moab!
Slagburn 02-19-2002, 06:37 PM Way cool!:)
Definitely post the specific information. I know lots of people get stress from those stupid Moab cops, be nice to have something to shove down their throat!
Curtis 02-19-2002, 09:13 PM It says right in the US Constitution:
Article IV. - The States
Section 1 - Each State to Honor all others
Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof.
Section 2 - State citizens, Extradition
The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States.
A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime.
Basically, this means, among other things, that a cop in Utah cannot ticket a citizen's vehicle from say Arizona for something that is illegal in Utah but legal in Arizona.
about the only things an out of state vehicle can be ticketed for in any state is being overweight or too long. Basically if your passenger vehicle is legal in your state you can go anywhere in the country with it. BTW there is a federal highway saftey law that says that somewhere so if you get ticketed out of state you can take the state to federal court over it :D

I wish a lot more folks understood that a bit of respect can go along way.
James K 02-20-2002, 06:42 AM The respect thing is so true.
After all you are visiting.
The two friends that have been pulled over( in all the years we have been going down) was because of wonder all over the road. Both times was outside of town and they were just running low air pressure and the officer just let them go about there way. They are checking to see if you're drinking and driving.
Cutter 02-20-2002, 07:15 AM last Sept. I had a cop in Moab pull on the road and haul ass right up on my butt, thought I was going to get pulled(8# of air and tires way out past fenders) over but he left me alone...but then I run a 'Disabled Veteran' license plate;) I've had nothing but good experiance with cops when i'm in my junk.
Greg W 02-20-2002, 08:17 AM I've never been bothered by the cops in and around moab. And yes the respect thing is true. I have 2 brothers who are cops. When they pull someone over for small infractions, it is the attitude the driver pulls that decides for them if they get a ticket or not.
BTW, that is some great information. Thanks for letting us know. have fun in Moab:D
borton 02-20-2002, 10:01 AM do post your findings when you get it, I want one for the next time I pull dads jeep out of my garage :D
