: If you have been cited in Utah - out of staters

I am trying to get some things changed regarding citing out of state vehicles for lift, mud flap, fender flares and other equipment violations in Utah. What I think will be asked in the very near future is evidence that citing out of staters is taking place. What I'd like to have from you is the citation number, the date you were cited, where you were cited and for what violations. Please do not include tickets for things like bald tires, broken taillights, drunk and disorderly etc... as those won't help. If you are concerned about your privacy and you do not wish to post to this thread, you can email me the information directly. mjw@mjw.com Your information is already a matter of public record however I will not do anything with this list other than to use it as weight to say "Yes, out of staters are being cited". I will however only use emailed information from people I know or have read from this BBS as I don't want any trolls polluting the database.

Please read For background information (http://www.pirate4x4.com/forum/showthread.php?s=&threadid=42976)

Thanks,

If you don't have your citation number just post/email the rest of the information.

Citation Number, Date, Where, For what violation (number and description)

I'll get my ticket out of my car and post it later but this is GREAT! I got cited for mud flaps during EJS. CAN YOU BELIEVE THAT!!!! I have a grand cherokee, there are like rock buggies with no fenders at ALL driving around and I got cited for freekin mud flaps, horse shit. Anyway I'll get the ticket and post for you when I got out to my car later, it's just like 1/2 mile out in the parking lot. Great subject though, I like moab but I'll be dammed if I'm gonna go there if I get shit from their fawkin cops every time. ok sorry for the rant.

Same thing happened to me last year at EJS. I got pulled over for no mud-flaps "in town" while buggies with no plates or fenders drove by. He gave me a warning since I had my removable flaps in the bed. However, he didn't say a thing about me having no doors or mirrors. I don't get it.

all you have to do is file for an out of state vehicle inspection exemption from the utah DMV. i dont have the specifics but i know of several people who file for exemptions for the states they go wheel in and they just bust out their certificate and tell the highway patrol to have a nice day because they are legally exempt from the misc :rainbow: laws. check into it!!

I was denied my EXEMPT STATUS PERMIT and I am now attempting to right this situation. Read this thread to see what I'm doing. Utah Lift Laws - Permit denied but making progress anyway (http://www.pirate4x4.com/forum/showthread.php?s=&threadid=42976)

With EJS ending maybe there will be more people who have been wrongfully cited. So far the list is lame.

Belly Dragger, I think this is cool that you are trying to do this but what in fact you are asking the state of Utah is change the laws just because you are there.

Example, WA state has higher speed limits on the interstates than we do here in OR. Should a WA resident be able to speed here in OR and be exempt? (i know, lame example)

And as far as getting a mud flap ticket while buggies are driving by, yes that sucks. Judge usually doesn't care either.

nope, he's actually just asking that the Utah Hiway Patrol follow their own state laws, state constitution, and the US constitution (all of which have laws regarding this) while he's there.

This is not even the same thing. He is not asking to change the laws because he is there. He is asking that personal property need not have to be altered to visit the state of Utah. I don't see the speed limit thing as being even close to the same thing, thats a safety thing - afterall we don't allow European tourists to drive on the wrong side of the road now do we ?

Ca. doesnt stop 49 state cars from entering, that is the sort of thing he is wanting. Whats legal at home should be able to freely travel thru other states. I emailed the state of Utah about this several weeks ago with no response.

Ok I misunderstood like I thought. :D

But in the original statement it looks like you are asking that Utah state laws not be applied to out of staters.

This seems like a good idea, but do you think it could backfire on ya, causing the utah boys to push nevada to ammend the same lift laws?

Not sure, just throwing up a suggestion. I do agree that it is wrog though.

Doubtful, they would have to push every other state into the same thing, which won't happen. If every state adopted the same laws, it would more than likely become a federal law, then there would be no chance for states to amend it and change it to suit there needs....

Actually California's motorhome length laws have been the subject of a lot of heated debate in the motorhome magazines this past year. California has a 40' maximum length and have been citing people with those longer than 40' both resident and tourist. There is however legislation pending to change the law, as at the same time they're citing these drivers the state does allow them to be sold in state, and collects taxes and tag fees on them.

If every state adopted the same laws, it would more than likely become a federal law, then there would be no chance for states to amend

Be careful what you ask for.;)

This kind of stuff pisses me off! In the US we are supposed to be guaranteed the freedom to travel, today our vehicles are used for that purpose.

It's fine with me that each state has it's own set of equipment requirements for the vehicles registered there, but those laws should not apply to those visiting for 30 days or less. In most states you are required to register your vehicle there after 30 days.

No, he's asking for Full Faith and Credit, like how a Colorado driver's license issued by the STATE of Colorado is perfectly valid in 49 other states. Or how a Nebraska debt judgment can be filed and thus enforced in Colorado.
