Nellie and I got home today from the doctors to find a running Mazda in our driveway. I thought it was someone looking for the people who lived here before we moved in in June. However, one of our dog came up to meet us, and we know we locked them in the house before we left. So, I knew someone was in the house.
I walked into the house and found our DVD player on the kitchen floor. I spun on my heels and went out to Nellie to call 911 on the cell phone. While I was explaining to 911 what was going on, I stood by the car and Nellie went into the house to see what was going on. I followed Nellie into the house to tell her to not touch anything to almost get run over by her running to the front door screaming someone was in the orchard with a weapon and threatening to kill her. That was it. I grabbed my shotgun asking her where he was and what he said. He was in the back yard and moved toward her with his hand in his pocket asking, "do you want to die?" She took off running toward me at that point.
Anyway, while I reached for the shotgun, I heard the car reeving and driving away. I took off running south toward the main road through the orchard. I've got the cell to my ear telling the operator how to get to our place (the county hasn't issued all the paperwork for the new address yet) and the shotgun in my other hand. He saw I was going to cut him off so he took off north through the orchard. I turned and ran back to the house and jumped in my Suburban telling the dispatcher I was giving chase.
I tore off to the west through the trees because I knew the only way off the property the way he headed was to the north-west corner. Sure enough as I made the road I saw his car coming through the trees. I got up to about 50 right away (thanks to turbo diesel). He stopped and picked up someone at the north of the orchard and just began to tear off to the north heading toward the road I was on. Now, remember I'm still talking to the dispatcher giving directions and telling her what I'm doing. I then decided at the last minute to ram their car.
I told the operator, "hold on. I'm going to ram him to stop him from getting away." I floored it and held on. I caught him HARD in the left rear tail light and pushed his car about 150 feet. He finally came to rest in the middle of the road. I grabbed the phone and shotgun and ran to the car (shotgun up and ready). The entire time I was yelling to them in the car saying I had a gun and would use it if they moved. Luckily, my plan of hitting them worked and knocked them both out cold.
I grabbed the driver and pulled him out of the car. He started coming to so I made him lie on the ground and not move. I then pointed the gun at the passenger (scanning the car for weapons) and told HER to get out. Her seat was all bent from the collision and very woozy. I made her come over and lie on the ground about ten feet from the guy.
At this point he made a movement like he was going to get up and moved his hand toward his pocket. I kicked him square in the head knocking him out again. I then patted him down while yelling at the girl to not move or I would shoot next time. All he had was a good sized pair of scissors and my wife's eye lash curler in his pockets. He could have done some damage with the scissors.
I then held them at gun point waiting for the cops to show up. As the cops were coming I asked them if they heard the sirens and that it was for them. I said, "and you're going to jail." The guy shrugged his shoulders at that. I said, "yeah, at least you'll get a bed and three squares." You see at this point I realized what they mostly had in their car from us was FOOD. They had our digi cam, camcorder and mag light. But, they had two of OUR pots, OUR bean, OUR tortillas, OUR tofu (?) and OUR tinfoil. What the hell is that?
Anyway, as the cop approached I told the dispatcher to tell him I put the gun on the hood, my hands in the air and I was backing away from the Suburban (didn't want to get shot). He stopped and I made sure to point out the shotgun and that I was the owner and the people on the ground are the ones who were robbing us. He was cool and cuffed them and then walked me aside and began questioning me.
At this point I realized the damage I did to their car. It is TOTALED. I pushed the entire left corner to the front seat. The rear axle is bent and so is the left rear wheel. It was the kind of Mazda that has a full piece of glass as a rear hatch so it was gone. The windshield even was broken either by them hitting it or from my fog light that ended up in the driver's side front floor. It is one dead car. My Suburban has a fairly good sized dent in the front bumper and one of the fog lights came off. Nothing much really. I guess that's what happens when an 8000 lb rig hits a 1500 lb car :D
I did end up going off to the hospital and am hurting big time right now, but it was worth it. I figured once he threatened to kill Nellie, it was on. No more games at that point. And, the cops didn't even file an accident report against me. They just put in the report that I used necessary force to stop the fleeing suspects after they threatened to kill Nellie and robbed us. The cops were too COOL :D
I had to tell the story at the hospital and everyone was going on about it. Even the people around me were cheering me. It was then that I realized I'm my own hero right now. Don't fawk with me :D

I thought they were cranksters at first too, but I found out that the girl and her husband (not the guy she was with) had just finished YESTERDAY as part of the work crew who picked olives here.
Anyway, the cops said they were definitely being charged with felonies :D

on another note, you are in kali, i would question putting this on public display, you kicked the guy in the head, that is use of a deadly weapon, may not want a statement like this coming back and kicking you in the ass if the guy has some serious problems and looks for legal retributions.

I was sure to tell the cops that I kicked him because I thought he was going for a weapon (and he did have the scissors in his pocket as I found out later), and I left the scissors there for the cop to find. I also made sure the EMT's gave him and the girl attention before me and let them leave on the first ambulance. So, the cops said not to worry, but like I said, I called my lawyer already.

This is the second time in my life I've used the same gun to twart this type of thing. Last time I actually shot it though as the guy took off over my fence (he didn't get in the house though)

I bet it was quite a sight seeing me run through the orchard with the gun and phone. Funny thing is I wasn't pissed at all. I just did what needed being done without even thinking about it. The operator even said thank you and was amazed at how well I handled the entire thing.
He couldn't have done much with the gun because of the trigger lock, and I keep the keys on me all the time. I may have killed him had he had the gun pointed at me in my own home.

Where I live, the cops would have written you up for the failure to display a front license plate - after you damaged it ramming them, and the grand jury would be talking with you. Then you'd probably get sued by the fawkers. Hopefully your state has the same law ours does denying a personal injury claim to people injured in the commission of a crime.
You did the right thing. Don't think I'd have had the balls. Need to get me one of them there shotguns (with trigger lock) and a matching Bat Cape.

Thanks everyone. I'm beginning to really hurt now, but I still say it was worth it. I'm going to call tomorrow to see if I can get the 911 recording. If I do, I'll post it up :)

i go to be batman last symester in school. i am still in college and i bounce at a club downtown. this was in january when it was cold out. well i had gone to the club to get my paycheck on a random weeknight, and while i was in there decided to hangout for a bit. well when i was leaving i saw a guy walking from the parking lot in a new remington fleace jacket. i was like "hey man thats a nice jacket i have the same one". and he was like yeah i just got it. and i didnt think much of it.
i go to my roommates jeep that i drove there and the windows were unzipped and everythign was gone. including my new remington polar fleece. so i took off after the guy. its 2xl and when i caught up to the guy and asked him where he got the jacket he took off running. so i had to chase him down. this guy filled out that 2x so getting him undercontrol took longer then i wanted. but i got him down and did a simple blood choke to get him unconsious long enuf to all the cops on my cell. well in the mean time the guy is unconsious from the choke. then some bystander, who works at the club but didnt reconize me for some reason, runs up and sprays me with pepper spray. so there i am trying to keep that guy from bleedin on my fleece while he is coming too, and trying to calm the guy that sprayed me with pepper spray, and breath with that shit in my lungs. needless to say the cops came and hauled the guy off to jail. they found 4 cdplayers, 1 phone, and a bunch of odds and ends stashed where i had caught up to him at.
the cops treated me like a king, it was great. the guy went to jail for assult on me, and b and e. it was great, i think its my one civic duity i have done. it was much more satisfing then breaking up fights and stuff liek that at the club. its also the first time i have used my training on a sober person, and the very first time with some one who has nothing to lose. lesson learned, criminals put up more fight then anyone else. i guess its the whole havign nothing to lose aspect. ok long story but yeah feeling like batman was kinda fun. gg man way to bust them theivs asses

My hat is off to you man. I commend you not only for your bravery, but your self control. Had I been in the same situation, after realizing that the SOB just robbed me AND threatened my wife's life on his way out... with any weapon at my disposal.... I'm not sure I would have taken your same approach. Personally, I think I'd pretty much loose it if I witnessed the same situation.

2. Don't wander into your house unarmed once you saw it had been broken into.
I would assume anyone that got into my house was armed and probably shot them on site if they didn't obey the first "STOP" command.

Not sure if the local paper will have anything because it only comes out on Wed and Fri (small town crap). Nellie was going to call the paper here and the one in Chico, but I don't want to deal with that ;)
Anyway, suprisingly I'm not too sore today. I thought I wouldn't be able to get out of bed.
BTW-Didn't win the Lotto yesterday dammit :(

CAPAY Burglars may want to think twice before they plan to victimize Curtis Machlan again.
Machlan, 41, and his wife Nellie returned to their Malton Switch Road home just before noon Wednesday to find their dogs loose in the yard and a strange car in the driveway with the motor running.
Machlan figured it was somebody looking for the previous residents of the home, but quickly concluded he was being robbed when he went inside and found his DVD player lying on the kitchen floor.
He hustled back to his Chevrolet Suburban to call police on a cell phone. He placed the call, then stood by the running car, willing to confront any fleeing suspects.
He then realized that his wife had gone into the house. She told him a young man had confronted her in the back yard and said something like, Are you sure you want to die, lady, and brandished what she thought was a weapon.
Tehama County Sheriffs deputies later recovered a pair of scissors from the suspects pocket.
The suspect somehow got to his car and began fleeing through an olive orchard next to the couples home. Machlan, who says he suffers from fibromyalgia, grabbed his loaded shotgun and gave chase on foot.
He knew there was only one way out of the orchard, so he went back to his vehicle and drove it into position to block the burglars escape.
Meanwhile, the suspect stopped to pick up a woman in the orchard, later determined to be an accomplice.
As the suspects headed for Malton Road, Machlan swung in behind them in his Suburban. When they slowed down, he rammed the rear of their car, a Mazda hatchback, at full throttle.
I didnt want to take any chances that they would fight me or pull a gun on me, so I went for it, Machlan said.
The impact totaled the Mazda and temporarily knocked out both people inside. Though hurt himself, Machlan grabbed his shotgun and scrambled to the suspects car.
As he got there, the driver was just regaining consciousness and started to reach for something in his pocket.
Machlan said he kicked the suspects hand away hard and told him not to move, all the while keeping his shotgun trained on the inside of the car.
Deputies arrived within about five minutes and arrested an unidentified 15-year-old Hispanic male the driver and 28-year-old Silviera Melo, a female believed to be involved in the burglary.
Both suspects and Machlan were taken by ambulance to a local hospital and treated for injuries. Machlan said he had just come from a physical therapy session and the collision aggravated his condition.
The teen-ager was booked into the Juvenile Justice Center in Red Bluff. The woman was charged with burglary and booked into the Tehama County Jail in Red Bluff with bail set at $25,000.
Machlan said if the incident had just been a burglary, he might not have chased the suspects. When he learned that his wifes life had been threatened, he said it made him mad enough to act.
Deputies recovered the couples video camera, a digital camera and miscellaneous food items from the Mazda.
Machlan said he was surprised to learn the male was only 15. When I asked him his age, at gunpoint, he told me he was 19, Machlan said.
The Machlans have only lived in their Capay-area home for about six months, but its already been very eventful.

Yeah, I don't know why he added that. We were just talking and he said that yesterday made for an eventful time since we moved in here back in June. I told him he didn't know the half of it and went on to tell him about my dog getting attacked by another dog that ended in a broken leg, that I had a really bad down turn with my illness and spent over a month in bed and had a severe neck spasm I was just finished with tharapy when I got home Wed. He asked what the spasm was from and I told him it was associated with the lightning strike. I guess he thought it made for good drama or something :rolleyes:

i'm not trying to rain on your parade, but aren't you trying to become a police officer? seems like you did exactly what police officers frown on. you get into a car chase with them, have a loaded firearm in the vehicle and then you ram their car to stop them. your lucky that you didn't end up in handcuffs. the only time you can use force is if they are a direct threat to you IN YOUR HOME. lets say you encountered them in your house, they run and you shoot them as they are fleeing, you become the criminal. if you want to be a police officer, you should be able to control your emotions better than that. i understand that you were pissed because this guy just threatened your wife, but if you want to be in law enforcement, you have to believe in the justice system and not take the law in to your own hands.

The reason is I didn't get pissed, it wasn't enhanced by anger or anything irrational. It was done because I was protecting my home (he never left my property even on chase), and I wanted to do my best to get a bad guy off the streets. I even put the trigger lock back on the gun once the officers were on the way, put the gun on the hood and backed away. Of course I was telling them through 9-11 exactly what I was doing while doing it too.
Every cop there, including the Sheriff's Capitan, shook my hand, patted me on the back, hugged me, etc. The DA called and thanked me and said they wished there were more people like me (able to keep a cool head and do what needs getting done).
Now, if I remember, you are a cop. Thank GOD you didn't show up on scene if that is the attituded you would have brought with you. :shaking:

Just telling you what I was told and the way the guys in uniform responded to the entire event. Also, keep in mind the chase never left my property (his car did end up off the property when I rammed him).

btw curtis, it doesn't matter if they did get off your property. You can use reasonable force to apprehend a fleeing felon. Wrecking their car in this situation was perfectly fine. I dont' know what this guy's problem is.

So, he told the cops he was sorry she didn't end up in the hospital extremely hurt, and he didn't bail her out. So, I don't think I have to worry about him ;)

I know MANY officers who loved this story and found nothing wrong with it at all. My great uncle was Chief of police in a town in So Cal and he also loved this story and wished there were more people willing to take a stand and not pussy out. I agree it could have turned out differently and someone could have gotten shot but that's the risk you take when your life and the lives of your loved one's are threatened.

That is what will be the death of our country. those who say we shouldn't do anything, we should sit back and let the theifs do their thing. The police will come and do a report, maybe make an extra drive around the block for secuirty issues, but probably will never lead to anything. and hey, we have insurance, they will pay for it! So, as we sit by and let this happen, these people go on thinking this is OKAY to do. shit, it must be okay, you (we accumilatively) keep letting it happen. I think we need more people to do what curtis did, and if he had shot the theif (whether this situation or another) it would have only better taught them a lesson.

There's the "right thing" and there's the "legal thing" to do. Sadly, here in CA, they are FAR, FAR apart.
actually, that's the majority view. You can't use deadly force to protect property. You can only use deadly force to end the threat of imminent death to you or someone else. Now, if he had blasted the dude when he pointed the 'gun' (scissors) at ole wifey, then that would have been more than justified.

i tried to stay away, but i couldn't. here's my response .
1st- you said that he "went for a weapon" after waking up from the ramming. so, the guy was out of it, right? so you proceed to kick him in the head while you have a fucking loaded shotgun pointed at him! i don't know about you, but if someone has a loaded shotgun on me, i'm gonna comply, period.
2nd- you said the 911 operator gave you permission to ram the car. in all my years in and around law enforcement i have never seen or heard of such ridiculous statement. but, i wasn't there, maybe thats the way your small town S.O. works. this just seems far fetched.

so you're saying that if you or someone's else's life is threatened by someone who purports to have a gun you should drop your gun and chase them unarmed? What f'g school of police OR common sense did you graduate from?
ok, i'm done with this thread. i can gaurantee(sp) that if took a poll of real police officer, you thinking would be in the minority. i spoke with numerous other police officers and they agree that what you did was wrong. everyone said that you stepped out of line when you rammed them with you truck, then proceed to boot stomp them afterwards. this is just mine and a few other law enforcement officer opions. so go about your day and hopefully you never have to deal with a real sitution such as this.
If that is really your opinion I am quite disappointed. How can you expect crime victims to just take it and not react to defend themselves/loved ones/property? When I lived in CA my truck was robbed 3 times and the cops wouldn't even come out and take a report. They said I would never see my stuff again.
If I had the opportunity to take the law into my own hands I certainly would have done so since there are about 1000 criminals for every cop in CA and you guys are never around when the crime is happening.
Remember, on private property the homeowner is in charge, not you or the criminal.

I'm with the Majority here. Had I been in that situation I'm afraid I'd be pumping shells at the car until I ran out of ammo. There would not have been a need to call 9-11 because a shovel and a can of gasoline would have burned the evidence of their existence.
As for Dinks view point I feel it may be his training that has him critiziting you with out really reading the details. Surely you folks realize that the NEW LEO'S are insulted when someone tries to do their jobs for them. They are threatened. What if everyone stood up for themselves. Would we need so many LEO's. There is a propensity to turn this Country into a Police State starting in California. Everytime I see a S.W.A.T. team on TV I think of the Nazi Storm Troopers. If S.W.A.T. is really necessesary then something is seriously wrong with this country. I know a lot of good LEO's, and like most of them. But it's those Cops with the "I'm the Boss" here attitude that make me wonder about where we're headed with this. I was brought up believing that the Police Departments are there to protect the public. Not to Bully and Force some incomprehensible law down my throat.
Now just so we under stand. I'm not blaming the Police Departments for the Countrys problem. As citizens we should have done a better job in raising our children to repect other peoples property and nurture right to feel safe wherever we may be. Our society has turned into a cesspool of human depravity. People are too lazy to work. They don't have too. The Government will bail them out. And the hard working Tax Payers are footing the expense. I say Welfare Program should be for those who are too sick or old to work who don't have a Family left to take care of them. Stop giving people the false beliefe that they DESERVE to have anything they want. To hell with that. If they do not work, then neither do they eat. Put the freebie burden back on the Families. Let the realtives take care of those relatives who are unwilling to provide for themselves. Government Assistance should only kick in as an assistance probram, not a free ride.
We need Police Departments because of the Society we have allowed to come into being. But, what we don't need is more Police with Attitude.

Me, I'd have shot the SOB, half unconsious or not ,when he moved for the item in his pocket he threated your wifes life with. How would I know if he was half awake or not. Ok, enough! Sorry I got carried away on this. I have been taking care of my 50 year old brother since 1995 because of his bad back. He's disabled, and divorced twice, but still there is work he can do to help me with his expenses. Yea, he's a pain in the ass, bitches all the time and smokes even though he can't afford it. But, he's my Brother, it's my job to help him. He doesn't have a free ride here either. Oh, and the Government doesn't contribute a dime either. Just so ya'll know where I'm coming from.

Not only did he reach into his pocket for what were actually LARGE sewing scissors (a weapon is a weapon), but he was continually pushing the shotgun to the side and swearing in Spanish (yes I speak Spanish). YOU may be compliant, but not everyone is, and a very quick review of any of the cops shows on the old tele will show that :rolleyes:

When I told her he was fleeing in his car and said I was going to give chase, she said "okay". I continued to speak to her the entire time explaining I was driving through the trees on my property. When I made it to the side road, I told her I was on the side road. When I spotted the car coming through the trees, I said "I am going to ram him to stop him." She said, "Okay, that's fine." Not at ANY point did she say to stop. If she had, I would have stopped my pursuit, period. Also, keep in mind she was talking to the officers on their way. NO ONE said to shut it down. But, all in all the chase lasted all of maybe 90 seconds if that.
