I bought a transmission and transfer case from Jared, AKA, thebaja1 (http://www.myspace.com/thebaja1).
I called him to verify this was a good running transmission. He said it was so I went from Ventura to Colton to finalize the deal.
I saw the transfer case had rust on the shift rails and the trans was dirty in the shifter base since the shifters were left off outside. I only needed the tranny and figured since there was oil in it, I could clean it out and install it.
When I go to separating the two, the trans was full of oil, some bearing particles and sand, and the t-case had water in it, although only about 6oz.
I pm'd Jared a couple times and got no response.
I called him and left a message and this is what I got back:

the tranny came out of a running truck, i pupped it out 2 or 3 days before i gave it to you. the only reason it was parked was the frame rusted out near the front mounts of the rear springs, so i dont really know what to tell you, and i dont know what your after, you already talked me down when you picked it up. i've sold other parts to other people and they have had no problems with their stuff

This trans is worthless. Good for a core is all. I have three people that were with me that watched the water run out of the transfer case. There was oil in the trans. After draining that, I saw the bearing parts in the bottom of the trans.
If this came out of a running truck, why is it so rusty inside the tcase where the shifter was?
What I am after is a good transmission. I don't want anything else except for what I asked for in the beginning.
I asked for a lower price because I always barter prices on a used part. I saw that this was not represented as you had said.
I would like to give this back to you and move on. It is the first time that I have had an issue with a deal on Pirate4x4. I have been on the BBS for 7 years and made hundreds of transactions along the way as well.
You say that others have not had problems with deals between you, what would you do if there were discrepancies? Just walk away?
I wouldn't. All I am asking is that the right thing be done here.

well between the price of a core for the t-case and tranny, is less than you payed
So here I am with what was allegedly a good trans and the seller saying I got a good deal on a core. WTH is wrong with this.? Am I missing something here?
Am I wrong wanting to reverse this deal now since I didn't get what I was paying for? Hell, I already have a good core. Why would I want two? :mad3:

As far as I am concerned, the contract that we made, was for a good transmission to be sold to me. We talked about that when I called you. This transmission doesn't match that "meeting of the minds" that we came to.
Basic contract law states that the essentials of a contract are; "parties are competent to contract, a proper subject matter, consideration,mutuality of agreement, and mutuality of obligation" 286 N.W. 844, 846; "a transaction involving two or more individuals whereby each becomes obligated to each other, with reciprocal rights to demand performance of what is promised by each respectively." 282P. 2d 1084, 1088.
The total legal obligation which results from the parties' agreement as affected by law." U.C.C 1-210 (11) Types of contracts included;
Oral contract
One which is not in writing or which is not signed by the parties; "within the statute of frauds [it] is a real existing contract which lacks only the formal requirement of a memorandum [signed by the party to be charged] to render it enforceable in litigation". 84 N.E. 2d 466, 467
I am not done with this. I will pursue it to all ends.

I paid for a working transmission, not a core!
I paid $160 for the setup down from $200.00 asking price. How do you check a trans for bearing issues at the side of the road/in a parking lot?
He gave me his word/said it was a good transmission.
I guess I trust people too much :shaking:

It doesn't sound like he was trying to rip anyone off based on his comments, it's just one of those things that happens on used parts sometimes. Anyway, probably the best solution would be for both of you to compromise a little. A top shift case is worth $100, so if the trans is junk maybe you guys meet in the middle and he gives you back $60. So in essence you got a top shift case for $100 and a free tranny core for your trouble. I think that would be a fair deal. Just my .02.

that sucks it is starting to get to the point where you cant trust and or rely an any one any more
i converted my rig to propane and i found a guy in town that said he had a tank for my truck and it has been two months since he said he was picking it up
and on another note i had a local company (Vilas motor works) rebuild my toy 3.0 v6 and when i got it back and finally installed...it leaked so much that it would lose a quart of oil in a day and a half.
so long story short...

Just because "it" was from a running vehicle doesnt mean that it is good.
Sounds like "it" was thrashed somewhere along the line.
Now with evidence of bad bearings/bushings,sand and water you would think the seller knew what condition this stuff was in!
If he is honest,I think he should work it out with you IMO.

When I called him to ask about the condition, he assured me it was good. I drove two hours one way to get it. I sure the heck wasn't going to drive that far without asking the questions one normally asks.
He sure as heck isn't very forthcoming here. I will be pursuing this in court.

Oh I agree he isn't steppin up now. But seems like he assured you it was good, without really knowing. Bummer there are people out there like this. :(

I have worked wrecking yards for several years....when it was possible to test an auto tranny, we would check it out as much as possible before selling it as good....we always pulled the pan and drained the oil for inspection. If there were pieces in there, it was a core. If the fluid was not burnt it was sold as a good used trans. If the vehicle was wrecked to where the trans could not be tested, we assumed (after checking fluid, and pulling pan) that it was good. It was sold as good used trans. If the person buying the trans was not happy, or the trans was installed and not working, it was replaced (our guarentee) or refunded. As for labor, that was a chance the mechanic had to assume. Reputation was a key for mechanics to trust us, and buy our parts. Baja should take the tranny back, since there were circumstances not known by either party. Sellers need to spend the extra time to check their product before offering it to buyers willing to spend hard earned money. Buyers need to make sure they check areas of the part that may effect its performance....if it is not possible, because of time, place or neccesity, be prepared to get burnt once in a while. Hope you guys can work this out.

Couple of things I see.
First, you are in the right.
You say you drove to Colton? If you file in small claims you'll have to file in whatever County Colton is.
Catch more flies with honey than vinegar. IMHO your first two messages to him were good. You jumped in on the third. If this guy is sketchy you've given him a "reason" now to stop talking to you. It's hard to deal with asshats but calling them an asshat only makes it harder.:shaking:
If you do go to small claims they won't care if you already have a core. I don't think your drive will gain anything either. You may not get the whole $160.
So you have 2 trips to Colton, to file & court date, that won't be re-embursed and you could be awarded the difference between price paid & core value.
So figure out what that is and if it's worth it to you. If you do go to court take the parts with you. Take only pics inside but if you win the whole $160 you can give him the stuff there and ask the court for a witness. He on the other hand will have time to pay you. If he doesn't, it's another trip to Colton and you may not get payment anyway.

The small claims court may give you the award (decision)-but they do NOT collect it for you, although the papers for garnishment of wages would have to be filed through the court following the stay of the judgement.

first of all i drove from barstow to colton, he knew the truck was parked for a year but still ran, and the only reason it was parked was the frame rusted out at the rear spring perches, i pulled the combo out 3 days before i took it to him, he started getting hasty and beligerent, i gave him the opertunity to say his peace in calico ( he told me he was going and its in my back yard )
I sold some stuff to a guy named rick in havasu, i drove the stuff two weeks be for he got it he said some parts were bad so we agreed on a compensation, and as far as i know he was happy,
i just dont care for people who call saying i owe them or they want to haunt all my posts, as far as im concerned thats bullshit, and ''toyrunner"i'm not goung to tell you where i live after the threating phone calls we had, i would have met you in calico because there were a lot of people around. if you want to discuss it further leave me a pm

So you are pretty much admitting fault then. Nice. You give him 1/2 is $$$ back and he still needs to find a working transmission. If he wanted to buy a broken transmission for 1/2 I'm sure he would have been looking for a broken one. He needs a WORKING one.
Just refund his $$$ and he can give your trans back. Then you can try and sell it BROKEN for whatever that will bring.

So, i will agree to half, and i told him i no longer need the set up back. if that will work then great, if not then:flipoff2: from this point good luck getting anything, and that is my final answer

If your convinced you sold a good running trans why would you hesitate to refund him all his investment, and simply resell this elsewhere...not here obviously. You still get your full asking price.

You must sue in the right county. If you file your claim in the wrong county, the court will dismiss the claim. Ventura County is the proper place to file if:
The defendant or the business involved is located in Ventura County.
The damage or accident happened in Ventura County.
The contract was signed or carried out in Ventura County.
For a retail installment account or sales contract or a motor vehicle finance sale: The buyer lives in or signed the contract in Ventura County.
Or, the buyer lived in Ventura County at the time the contract was entered into.
So I am filing against Jared Louis thebaja1@hotmail.com on Monday. He needs to come to Ventura to answer this warrant of debt. I told him I was not going to let it go. :laughing:

how can you pull the drain plug and assume it bad? I would have pulled them apart before comdemning them. I have seen plenty of metal come out of toyota 5 speeds and had no noise or problems with them. if the truck was a wheeler, people forget to change fluids after river crossings all the time. of course the shifters are going to rust, because if it sits any amount of time, the water seperates and goes down, but the steam formed while driving does up.
I wouldn't give anymoney back on a I pulled the drain plug and figured it was bad.
I see no reason to get butthurt about a little metal that probably will not hurt the unit for at least the next few years. you bought used working parts. as far as you know it does work. you can't tell by pulling a plug. you may have 7 yrs on this bbs, but I have 10 working for transission shops and dealing with toyotas.
Btw I do not know either of you, this is not supposed to help one more than the other, but I feel you're unprofessional opinion may hurt the way people deal with you. I am sure next time you post a wanted ad somebody is going to think twice about helping you out. because the used parts are "used" and not "brand new" condition.
don't you think if you wwere looking for a 100% reliable for 10+ yr trans, you would look into a factory reman, and not on a website for less than core value? I pull 6oz of water out of my t-case after every fordyce run.
how much for the "good trans"? and would you deliver? :flipoff2: I Have paid 150 for really junk w-56's just for a good mainshaft and counter shaft. and davez gets 200 for his cores.

I have said several times in this post "I saw parts of bearings through the shifter hole,in the bottom of the transmission". I don't want to pull it apart til this is done, IF I keep it.
This raised a red flag to me. I have bought several used items off this board and not had any troubles.

I actually thought the transmission was good from his description of it til I saw bearing parts in the transmission.
I'd like to see you do a trans r&R in under an hour. That is pretty fast there :cool2:
I must be slow cuz it takes me at least 3 hours to change a clutch without benefit of a lift.

I got a side by lift, a 2500 dollar trans jack and lots of wobblies and tools. and the cordless impact helps a lot too :D. helps to have you tool cart set up and memorized too.

I have been working on toys for years and know a fair amount. I don't do it for a living per se, some side work and mostly hobby. Keeping the rig running stuff.
I could do it in my sleep, just don't want to take the time to do it twice.
I'll see what happens in the next month and go from there.

first of all i drove from barstow to colton, he knew the truck was parked for a year but still ran, and the only reason it was parked was the frame rusted out at the rear spring perches, i pulled the combo out 3 days before i took it to him, he started getting hasty and beligerent, i gave him the opertunity to say his peace in calico ( he told me he was going and its in my back yard )

Well, I am Rick, in Havasu. Baja1 sold me some parts for a samurai namely; a 4 to 1 t case and two axles, with detroits. All opperable, and useable. These were a gift to my wife for her Sammi, so I never haggled price and agreed on a rush decision and meeting place to get it done. I showed, he showed and we transfered parts. I am an extremely trusting person and just paid for the stuff w/out checking anything. Long story short the front had a lockrite, the rear was welded and had a broke axle, the Tcase was as described. I was pissed, but I was understanding that something may have happened. I simply sent a PM saying we had a problem.
When I spoke with Baja1 he said, "that was what he was told when he bought it." So he bought back the rear end, minus the third that I had already installed, plus he had it delivered to a place near me pretty much on my terms!:smokin:
I know I over payed for my parts, but I made haste in my decision due to circumstance. It turned my gift into a serious pain in the ass, but alot of the blame was on my own trusting nature, I knew it was used stuff.
As a gift the wife was stoked, Baja1 made it right by me and I have moved on. Basically I would buy from Baja1 again, but I would just have a whole lot more in the way of conversation/confirmation.

No, I bought a good one locally. I don't have the time to do it twice. He implied he would take care of the matter.
I really wish I had the time and place to take it apart to see what is wrong/why there is metal in it.
