Park is TEMPORARILY closed effective May 9, 2007

Dear Off- Road Enthusiasts,

It has been brought to my attention that the local Henry County Zoning Commission has received incorrect information regarding OUR PRIVATE OFFROAD CLUB and has thus required our club to close until the next zoning board hearing. It appears that some local individuals are under the impression that HillzNHollarz is a “commercial” business operating in an A-1 zone. HillzNHollarz is nothing more than a holding entity for the operation of our private club. The local zoning board indicated that since I have a website, then I am a commercial business who is using the internet to promote my “business”. The website was designed to answer questions about our club.

Our private club was formed solely for the enjoyment of off-road riding. WE ARE NOT A COMMERICAL BUSINESS! With all of the problems Henry County has had with trespassing and illegal riding, the property owner saw this as a viable way to reduce trespassing on other properties while offering a safe riding environment for those who enjoy this pastime.

The landowner placed our private club under a non-profit organization and named it HillznHollarz. This was done to let everyone know that this not a business but merely a private club for off road riding. The landowner wishes to allow anyone who enjoys off road riding a place to enjoy his or her pastime. The proceeds from your $20.00 donation go back into our private club to enhance the property with amenities: gravel access road, restrooms, electric hook-ups, etc, property management, and security.

It is unfortunate that at this time that the HENRY COUNTY PLANNING AND ZONING has requested a SEIZE of operation until the next zoning hearing. Ironically, there is no meeting this month and the next meeting is scheduled the 4th Monday of June, 2007. Please note this is only a SEIZE to operate HILLZNHOLLARZ- a non-profit organization and NOT a seize for the landowner to invite his closest friends to come and ride.

This information was received on May 9, 2007 via mail. I am working closely to have our club back open. The local Zoning Administrator, Greg Derossett indicated that individuals who have permission from the landowner are allowed to operate offroad vehicles as long as no admission is charged. I am going to meet With Mr. Derrossett this Friday to discuss.

My question to each of you is: If the private landowner agrees to allow access to his trails, would each of you be willing to help assist in covering the cost of maintaining the access road and other amenities? I would suggest $20.00 per vehicle and $5.00 per passenger over the age of 18 per each visit to the private landowner’s property.

If you feel compelled to write an e-mail as to why this club is important to you and/or your family please e-mail hillznhollarz@aol.com. These e-mails will be presented at the local zoning board.

Dear Off-Road Enthusiasts,
As many of you know, HillzNHollarz received a Cease of Operations Letter from GREG DEROSSETT-Henry County Zoning Admin. I had the opportunity to meet with Mr. DEROSSETT last Friday to discuss this cease of operations and several other issues regarding the operation of our private club. Mr. DEROSSETT indicated that in order to operate a private club or recreational facility, one must apply for a conditional use permit per the Henry County Zoning Ordinance. On May 4, 2007, I received my first letter from Mr. DEROSSETT indicating that I needed a conditional use permit and for me to simply come to his office and pay the appropriate permit fees. 5 days later on May 9th, 2007, I received a 2nd letter from Mr. DEROSSETT indicating that I needed to cease the club operation ASAP. In that same letter, Mr. DEROSSETT indicated that I had 14 days to cease operations of the park and come before the zoning board for a conditional use permit. (Confusing, huh?)
It strikes me odd that I would receive 2 letters from Mr. DEROSSETT less than a week apart both contradicting the other. Upon further research I found that Mr. DEROSSETT has been in his current position since November 2006 and this is his first debut as a KY zoning Admin. I have also learned that Mr. DEROSSETT has contacted the Army Corp of Engineers with water concerns regarding the park. The Corp was unaware of this club until Mr. DEROSSETT contacted them.
The local zoning board has agreed to hear our message about obtaining a conditional use permit to operate a safe, LEGAL riding environment for off road enthusiasts. Law Enforcement has recently purchased ATVs with OUR TAX dollars to help reduce criminal trespassing and illegal off road riding throughout the county. It would seem that a SAFE, LEGAL, Off-Road club/park would be a welcomed site to Henry County.
I believe that some locals are under the impression that this park/club is not needed. (Some of have political agendas others have personal agendas).
I am asking for your PERSONAL support to keep this park/club open so that you, your children, and their children will have a place to enjoy nature without having to worry about being arrested for trespassing.
Please join me and other off-road hobbyists from around the state to share and voice our opinions at the upcoming zoning hearing. Attendance speaks volumes. If you are unable to attend, will you please e-mail a letter to hillznhollarz@aol.com stating why you enjoy this park/club, what it means to you, and how it will affect you if this park/club goes away.
Being a current property owner of Henry County for 9+ years and having a place to ride is very important to me. What concerns me is if this conditional use permit is not granted, where is everyone that doesn’t own land going to enjoy their hobby? The same place many of you have been going for years….out of state? 2-5 hours away? Trespass? The options are few.
PLEASE HELP US SAVE OUR HOBBY! I need each and every one of you to voice your opinion, whether in person or by e-mail. Your voice counts! Let Mr. DEROSSETT know WE need this place!

I would like to add this, when y'all posted on all the forums about your park, it was just that a park, had nothing to do with a club. Now it was assinine to try and slip thru the cracks as a non profit orginization when you charge $20 a day to ride. What have y'all been open 2-3 months now?

Pretty much y'all screwed up and did'nt go the correct path with the park to begin with, Im sorry but it was opened with the intentions of being a Bussiness. Not just to give people a place to ride. Or a "Club". You advertised it as a park, therefore should have went thru the correct channels with the county and registered it as a bussiness.
