Time for action!

Please contact any or all of the following members of the Assembly as them to support SB-742. This needs to be done TODAY as they will be meeting on Thursday. All you need to say is you support SB-742 as it is balanced bill for the OHV users as well as protecting the environment.

We need to get this bill out of committee call now or real soon. Sorry for the short notice but we were waiting until we knew we could support the bill and we do.

It's 5:50 am on Thursday and there still is no new version of the bill posted for the public to read so that we can make educated comments on the bill.
It's due to be heard in committee today. Did the folks at the bargaining table reach a consensus or is the bill going to die??

I know it is odd to send letters of support for something you haven't yet laid your own eyeballs on, but there are a few people who get my support without question, if they request it -- and John Stewart (he started this thread) is one of them.

I've heard of a possible reason that the contents of SB742 hasn't been posted on the legislative website yet. There was a BIG pile of bills (very true) that went to and through the appropriations committee Wednesday and Thursday and so the legislative staff was not able to process it in a timely manner.

Who determines the total amount of money that goes to the Grants program ($18 million)? I know it is appropriated by the legislature, but what is the criteria for determining the amount? This concerns both the present program and what is contained in SB742.

OHVMR is funded by sources directly related to off-highway vehicle (OHV) use: fuel tax revenue, fines and forfeitures, OHV registration, day use and camping fees at State Vehicular Recreation Areas (SVRAs), and interest. These funds are listed separately from those of California State Parks in the Governor’s budget, and are used to manage OHV recreation.

Specifically, the "grants" are derived from the formula in the gas tax study that allocates a percentage of gas tax paid while using a vehicle "off-road".

The amount of grant funding is determined by the State Comptroller and requested within the Governor's budget for allocation.

Thanks John. This is what I was looking for. Haven't been able to find it in any of the California Codes. Does someone recommend an amount to the Comptroller? The codes say up to 50% of the OHV fund could be allocated.

SB 742 as amended passed Assembly appropriations by a vote of 15-0. all Democrats voted aye as well as 3 Republicans: Bill Emmerson (AD63) from Riverside, Sharon Runner (AD 36) from Lancaster, and Doug LaMalfa (AD2) from Northern California. Abstaining were 2 Republicans, Mimi Walters (AD73) from Orange County and Alan Nakanishi (AD 10) from the Sacramento area.

Did it come out the way it went in? Yes

Are we supporting it? Yes

Who do we contact, State Assembly and Senate members? All State Assembly members.

How long do we have? this is a good question as we are sure when it will go to the floor for a floor vote we hope it is soon because as things will get towards the end of the legislative year things get weird at times.

John Stewart, I have another question about SB742. What data will be used to determine how much money will go to the CESA account? If they use the present formula, it would be a significant amount. But, if they use the data from the last fuel tax survey, it would be very little.

8352.8. (a) The Conservation and Enforcement Services Account is
hereby established as an account in the Off-Highway Vehicle Trust
Fund created by Section 38225 of the Vehicle Code.
(b) Funds in the Conservation and Enforcement Services Account
shall be allocated to the Division of Off-Highway Motor Vehicle
Recreation of the Department of Parks and Recreation for
expenditure when appropriated by the Legislature for expenditure, upon appropriation by the Legislature, for the following

(1) Up to the 40 percent of the funds, for cooperative agreements
or challenge cost-sharing agreements with the United States Forest
Service and the United States Bureau of Land Management, to complete
necessary route designation planning work and to implement route
planning decisions.
(2) Up to one million one hundred thousand dollars ($1,100,000)
for each grant cycle, to increase the amount of funds available for
restoration grants in the program pursuant to paragraph (2) of
subdivision (b) of Section 5090.50 of the Public Resources Code.

I just did, but I can only make the argument as one person within one district (for Dave Cox, Senate District 1 and Roger Niello, Assembly District 5). Hi, my name is Randy Burleson and I'm a Fair Oaks constituent -- I just wanted to pass the message along to Roger Niello/Dave Cox that Organized Motorized Recreations needs your support for Steinberg's SB-742 as it is balanced bill -- it protects the OHV hobby and also protects the environment.
It is a good bill I fully support -- even with the modest fee increases that will be levied against my motorized recreation activities. Failure to pass this bill will likely result in closure of existing state vehicle recreation areas and cut 400+ jobs that support these sites -- please support SB-742.

For those that haven't done this before, they will generally ask for name, address, and zip code so that they can validate where you live, and if you are a constituent. This is really pretty easy if you prep your 'script' before hand to keep it short and sweet (the folks at the other end who have to write this down will appreciate it!)

Here's an email from our friend, Helen Baker:

...When I talked to Steinberg's office this morning they sounded confident, saying that it "was just coming back to the senate for concurrence." It passed the senate first time around by a vote of 21-17, mostly on party lines, with the democrats being in the majority. The bill has changed quite a bit since then (in favor of motorized recreation) but with the overwhelming vote in the Assembly it shouldn't be a problem. In fact, we expecting that a considerable number of the 17 noes will change to ayes.

That said, this is still well worth calling your senator to ensure his/her support. Remember, the Anti-Access Activists are working hard to try to defeat this -- we need to keep the heat on so that our supporters at the capitol are not swayed.

SB 742 passed the full Senate on September 11 by a vote of 30-5 and is now on the Governor's desk awaiting his signature or veto. Although I opposed this measure when it was originally heard in the Senate in June, Assembly amendments satisfactorily addressed the provisions in the bill to which I objected, and I voted in support of the measure when it was returned to the Senate for concurrence.

This has been an unusual year. With the Governor traveling the world this month (China, the United Nations) a lot of bills remain on his desk (about 344!), which must be dealt with before midnight on October 14. Both of us have many other bills that we are tracking for other clients.

We and Daphne are working on talking points and should have them out by Tuesday of next week. We wanted to give you a heads up that SB 742 has been signed.

The bill does not take effect until January 1, 2008.
