: Reckless driving ticket
GOAT1 06-16-2002, 10:45 PM I recently got a reckless driving ticket while on a one lane dirt mountain road. It was a fish and game bitch on a power trip. I was coming around a corner in front of her, she said I was almost on two wheels and in the middle of the road. (the road wasnt wide enough for two vehicles). I guess my jeep leans alot. I was probably going 30-35 mph and I wasnt even pitching it out.
Anyway, has any had a similar experience and what did you tell the judge and what was the final damage?

Danger Ranger 06-17-2002, 06:46 AM when i got one of these, judge said maximum fine is $5000 (if i remember right) and up to 6 months in jail. I said guilty and give me what i got coming, i walked outta there with a $400 ticket. I'd keep your mouth shut.
From personal experience with people in general (especially people in authority positions) dont talk if they seem mad. If the judge seems to be taking this as a personal thing, staring you down and asking you WHAT IS YOUR EXCUSE? DID YOU WANT TO KILL SOMEONE and such, then just apologize and be HUMBLE!
Nothing your gonna say si gonna change their mind.
If on the other hand they seem open minded and free to suggestion, then give a very respectful spin of your side of the story and end it with this is how the situation seemed to me.
if it was ME. i would get a lawer and fight it. i have been charged with worse and gotten off. at least talk to a lawer. fish and game is not trained to judge vechicle speeds and probally has no training to back up her claim as to what is reckless driving. also a good chance fish and game would not show up to cort for a vechile code trial. they have there hands full with animial stuff.
thats just what i would do. if you plead not guilty and go to jail don't blame me :flipoff2:

In GA, Reckless Driving is as bad as D.U.I. The insurance companies really kick off in yer ass after one too.

Gordon 06-17-2002, 08:24 AM My buddy got trespassing in a motor vehicle from fish and game. We were taking a road that was marked and on a map, but I guess it was part of a state park. We were 16. Anyway I went to court with him and we just denied it. The fish cop didn't show up and the judge suggested dropping charges. For some reason the prosecutor didn't want to, but agreed to reduce the charges to "driving in a field" which had a $50 maximum fine. Then the judge found him inocent just for spite.
GOAT1 06-17-2002, 07:46 PM thanks for the response, I agree with what camo said, I wouldnt think the fish and game are the best vehicle speed judges or up on traffic laws, the nice lady even had to get out her code book and study up before she filled out the ticket. and the tyty aproach was my plan anyway. You should have seen this bitch, I think I just scared the shit out of here, she was so f'ing mad I couldn't even say a word without her chewing my ass off. Hopefully she won't show up in court.
ROCKILLER 06-17-2002, 11:42 PM I fought a reckless driving/unsafe lane change/passing on the right ticket and one. The secret is planning. You should talke to a lwayer but you dont meed one in traffic court with you. You'll look like youre guilty for trying so hard. get all the facts possible. look in the vehicle code. measure the roadway. explain the rolling action of the jeep and how it is not possible to get up on two wheels, it would slide. also bring up the fact that she was scared and upset. be as polite as possible but they are sworn to the truth and will have to admit it. put the most important information on a poster board but dont make it too cluttered. you have to seem like you really believe that you are right. not just that youre trying to get ouit of the ticket. good luck.
Dan-H 06-18-2002, 10:10 AM I agree get a lawyer, do not present the case yourself.
Get him to do all the talking have him tell you what to say and what not to say.
(s)he can be un-emotional about it and present a clear picture.
you cannot be un-emotional, and you will not be able to react to anything that comes up.
Get a copy of the police report and take it with you when meet with your lawyer.
Also, check your insurance. Believe it or not, mine covers legal defense of traffic violations. yours may too.
Keep in mind the DA may choose along the way to soften the charge. Be mindful of what options there are. A wreckless is as bad as a DUI in Ca, but so is engaging in a speed contest or exhibition of speeed, just not quite as bad.
If a speeding ticket is offered, jump on it and pay the fine. They may throw max fine for the speeding ticket at you but at least you will be able to get insurance.
