Southern Four Wheel Drive Association (SFWDA), the BlueRibbon Coalition (BRC) and United Four Wheel Drive Associations (UFWDA), will file suit against the U.S. Forest Service to restore access to improperly closed off-highway recreation trails located in the Upper Tellico Off-highway Vehicle (OHV) Area in North Carolina.

On December 18, 2007, the agency issued a closure order which UFWDA, BRC, and Southern contend is based on outdated and incomplete science. The law suit will seek to declare unlawful and set aside the closure order.

“Our organizations value their relationship with the Forest Service, however management by closure does not address the issues we need to be surmounting through collaborative and creative efforts,” observed Jay Bird, of Southern Four Wheel Drive Associations. “There is no defensible scientific correlation between OHV use and water quality, erosion, and sedimentation issues in this area, and our organizations have long demonstrated their dedication to the environment and support of trout populations in the area through user education, route maintenance and improvement. Active and effective management of motorized recreation, not prohibition, is the only good answer for protecting water quality and species habitat at the Upper Tellico OHV area,” Bird concluded.

Yep, we are filing suit. We at SFWDA are very sorry that we have been so quiet over the past few months, but we were busy working to get to this point. The suit should be filed shortly. We will be asking to have the closed trails reopened.

Now is a good time to consider donating to Rescue Tellico. All funds will go to help us get the closed trails open, and to keep them that way.

the science is inconclusive. they're taking the closure as validation that their assumptions are the correct ones.

They found out that water quality met state standards throughout the winter closure, but on opening day in early April, sediment in the Tellico River was more than twice the legal limit.

How is this possible? The trails they closed that they said was the problem didn't open in early April.:flipoff:

What native trout. They are all stocked, just like the rest of the trout streams in south. They don't have a chance to survive because the savages are chasing the trucks to the stream to catch them all before the fish have a chance. Careful hugging trees, you might get a splinter.

Maybe I'm off base here, but isn't April around the time when snow starts melting off the mountains, and Tellico gets a ton of rain?

It seems to me that increased rain/run-off = more sediment coming off the mountain. :confused: Of course theres going to be more sediment coming off the mountain in the spring. :shaking:

I looked at average rainfall and total amount for the months of March and April. It pissed rain that entire weekend and didn't let up till Sunday afternoon. My opinion is that it was Trail 1 and the runoff from it not the trail system. Regardless, it needs maintenance too but a lot of the focus has been on the trail system within the forest and not the access road. There was more traffic on Trail 1 then in March.

Biased scientists trying to generate the data to support their theories/agendas usually end up getting what they want. Of course the trails went from zero activity to balls out in one weekend. If Trail 1 is a big problem then maybe we can implicate the fishermen too.

According to their assumptions there should not have been such a occurrence that weekend. The trails that they determined were problems weren't ran. I'm also making an assumption about Trail 1. The reason i say it is because it runs right next to the river and it was f-ing disgusting by Sunday.
