My boss and I ordered a couple of the apex m64 kits to build. Then last week he went to the gun show and while looking at a dealer's table mentions to the guy that he's planning on doing a reweld, and the dummy behind the table goes into some talk about it being illegal. I told my boss afaik and have seen it's just the same legally as building a stamped receiver, and that [whiny teenager voice] "everybody does it" [/whiny teenager voice].:laughing:
I swear I read somewhere that confirmed it was legal...but have been searching here and at the akforum and can't find it. Anybody know where to find this?

As long as it doesn't have the happy hole, and no more than 10 imported parts, it's legal.

Send a letter to the ATF Tech branch. They will confirm one way or the other. If they confirm in the affirmative, then you have written permission directly from the authority, and no one can give you shit one way or the other.
My personal inclination, is that when the receiver was demilled, it was no longer a firearm, and simply raw materials. Welding it back into shape would be manufacturing a receiver, just as bending a flat would be, and would be treated the same.
But don't ever rely on logic to cover your ass, when dealing with the ATF.

True. I wouldn't think it was as much of a gray area as rebuilding suppressors, but then I don't see a problem with that either.

It is exactly like sully mentioned.
Once the receiver has been demilled, it is considered scrap metal, and not a gun--otherwise every bit of the receiver would have to be removed at the port.
By rewelding, you are making the receiver.
Some of the guys who sell reweld plates have even gone as far as to get in writing that the repair plates are NOT considered an FFL item.
