VICTORY - CPSC Votes One Year Reprieve on Youth OHV Ban

The General congratulates all the troops for making thousands of phone calls to the Consumer Product Safety Commission and to their elected representatives asking them for emergency relief from the proposed Feb 10 ban on all youth-OHVs.

It talks about the thousands of emails and letters that the CPSC and elected officials received from people like you who took the time to get involved. Thanks to BRC, NOHVCC and other groups and media/web (Pirate4x4, 4x4 Wire, Del, etc) outlets for doing alerts, blogs, and fwd info to the public.

Some dealers sent me the news early today about a CPSC “reprieve” being a victory. Upon further analysis… it is only Ľ of a victory since the CPSC provided no relief regarding the February 10 ban which prohibits powersports companies from selling youth OHV products with lead content in excess of the limits. The CPSC action only stays the testing and certification requirements for those companies that know their products do not exceed the limits. The General continues to urge his troops to send letters to the CPSC and Congress to grant MIC and Industry petitions regarding this issue.

Yamaha has advised its dealers today that:

No matter what you may have heard from any other source, DO NOT SELL new orused Yamaha TT-R50E, PW50, or Raptor 50 models or the parts and accessories for them on or after 2-10-09 unless advised by Yamaha that they meet CPSIA requirements. The CPSC and others can impose strict penalties on you for noncompliance.

The manufactures will "get the lead out" after that they'll just move on to some other hazardous material, just like the Eco's do with endangered species, we're going to get worn down it's not a matter of If, just When...TJ:(

Feb. 6 CPSC News Release Offers No Help for OHV Ban

is of little help to the Powersports community. The General believes that totally inaccessible parts have always been excluded from the lead content limits. However, the problem is, there are many components/parts on ATVs and motorcycles that contain lead and are accessible (e.g. levers; tire valves; suspension parts; external engine parts; etc.). The MIC petition expressly seek an exclusion only for accessible lead-containing parts, components and accessories

I like to think of it as more they keep trying and we keep exposing the fraud.

I wish they would figure something out. Luckly we didnt reorder much after christmas so we only have 5 TTR50 and no 50cc ATVs.

No word from the manuf. this morning, guess I have to put the little bikes up until further notice.

Bikes have to go from public view for sale, advertising, etc.

Replacement OE parts too must not be sold.

This means on the shelf and at least Yamaha has "blocked" the replacement parts from dealer sale.

If this is not resolved rather quickly, I see class action lawsuits from the dealers to the OE's.

The manufs know that, at least they have put all existing units in inventory on hold under the floorplan so we arent paying for them.
