: just got pulled over for being lifted....
desertPOS 08-27-2002, 02:11 AM Just got pulled over, cops excuse was that I was lifted. He told me it was really a sobriety check, which is understandable, but he explained to me how he was in a charitable mood and wouldn't write me any of the tickets that he could. He also gave me sort of a 'heads up' about some of the 'illegalities' of my truck. He noticed that I had a brakelight out, and also that I wasn't running any shocks in the rear, which I agree should be fixed (shocks will be on by end of the week). Then he told me that if he really wanted to he could put on his coveralls and start checking everything else on my truck till he found something else, and tow my truck (truck can be towed if 3 or more mechanical defects are found, hauled at owner's expense and can't be taken home 'till all defects found have been fixed). I asked him what he saw that was illegal besides taillight and shocks, and he told me that virtually any modification to or unsafe steering systems, braking systems, intake, exhaust, and suspension height are illegal. He said he could probably measure my headlight height and find #3 right there. He was actually very cool about everything and I didn't receive any tickets. Is there any truth to the modifications being illegal part? I plan on stopping by my library tomorrow to pick up a vehicle section code book or whatever 'cuz I really want to know. Just seemed to kind of take me by surprise, didn't know it was illegal to modify intake? Brakes and steering? Oh yeah, im running AP 5.5's and hysteer front and chevy's in the rear.

It kind of sounds like he was messing with you in a way....what is your intake that is illegal?
hy_desert_4wheeler 08-27-2002, 04:23 AM You are in California EVERYTHINGS ILLEGAL also every thing causes cancer
JParuBob 08-27-2002, 04:52 AM actually, California is a major dick about everything... If you have something that doesn't have a CARB certification #, then you pretty much can't LEGALLY do it... That applies to intakes, exhausts, everything pretty much (as far as engine related stuff goes)...
xj4rocks 08-27-2002, 05:06 AM For what's it's worth I got pulled for being too tall on Sunday night. The :flipoff2: Bastid DID give me a ticket. no work order so I guess that is good. my rear bumper was 10" over the limit. (which is 22" from the ground)

I think NC has a few laws too, but I've never heard of a case where someone has gotten a ticket for being too tall. They did raise the price of inspections from $19.40 a year to $30 a year.
Kicker 08-27-2002, 06:49 AM I don't know about anywhere else, but here in Michigan you can beat the "too high" thing by having a drop hitch. My buddy has a Superduty that is sitting on 44" tires and has the lift to go with it. Cops pulled him over the first time they passed him.
The next day he put a drop hitch in the front bumper. The thing is about as long as my arm!!
It works, and you can just pull it out when you wheel.
Hope that helps.

scwafish 08-27-2002, 06:56 AM I drove my rig to the local OHV park the other day and when I was coming back there where two Sherrifs behind me...I was sweating it because my rig is a semi-bugy....I have tires sticking WAY out, no windshield, no mirrors etc. I do have brake and turn lamps. I pulled over assuming they where after me, they slowed enough to say "nice rig" and they kept rolling. It was a good day.
fj40guy 08-27-2002, 07:00 AM Yep, could have busted you big time! On the positive side, you were nice to the cop and didn't give him chit for pulling you over (or the story would be different).
Just wondering... older Officier? Older ones have been around, and usually are more cool about pointing out stuff that should be done. Also ones that have seen rigs flipped from going around a corner too quickly!
Fix the tail light. GET SHOCKS ON IT NOW! and address any major safety stuff. Aim the headlights down so you don't blind on coming drivers (us old Farts who have a harder time seeing at night).
Funniest one... getting stopped in a "no way street legal" vehicle and having a cop suddenly say "Oh, good evening SIR, I see you are driving your son's car.... have a nice evening". Damn, not sure to be pissed that I am an old fart, or glad I got out of a ticket!
Since you asked:
CA Vehicle Code (http://www.dmv.ca.gov/pubs/vctop/vc/vctoc.htm)
Division 12 (Equipment of Vehicles)

desertoy 08-27-2002, 07:30 AM Here you go:D
24008.5. (a) No person shall operate any motor vehicle with a frame height or body floor height greater than specified in subdivisions (b) and (c).
(b) The maximum frame height is as follows:
Vehicle Type Frame Height
(1) Passenger vehicles, except housecars
23 inches
(2) All other motor vehicles, including housecars, as follows:
Up to 4,500 pounds GVWR
27 inches
4,501 to 7,500 pounds GVWR
30 inches
7,501 to 10,000 pounds GVWR
31 inches
(c) The lowest portion of the body floor shall not be more than five inches above the top of the frame.
(d) The following definitions govern the construction of this section:
(1) "Frame" means the main longitudinal structural members of the chassis of the vehicle or, for vehicles with unitized body construction, the lowest main longitudinal structural members of the body of the vehicle.
(2) "Frame height" means the vertical distance between the ground and the lowest point on the frame, measured when the vehicle is unladen on a level surface at the lowest point on the frame midway between the front axle and the second axle on the vehicle.
(3) "GVWR" means the manufacturer's gross vehicle weight rating, as defined in Section 390, whether or not the vehicle is modified by use of parts not originally installed by the manufacturer.
Amended Ch. 718, Stats. 1987. Effective January 1, 1988.
Rip DeLips 08-27-2002, 07:39 AM I think NC has a few laws too, but I've never heard of a case where someone has gotten a ticket for being too tall. They did raise the price of inspections from $19.40 a year to $30 a year.
That's why my shit is registered in Pamlico County instead of Wake. It's the regular $10 (or whatever it is) inspection and NO emissions check. Emissions wouldn't be a problem though as far as I know.
Chris Geiger 08-27-2002, 08:08 AM California has a lot of rules. It seems that after your rig evolves to a point they start pulling you over and checking it more often. If it's got lots of dents or no mud flap expect to get pulled over often.
My rig is completely street legal - as long as it's on it's trailer!
unissamog 08-27-2002, 08:28 AM Man I love Vermont.....31" frame height , fenders, and mudflaps.....that is basically it. Oh ya, less than 13.5' tall and 8.5' wide.
We also have a classification for registering that is "homebuilt" which changes all the rules.
Scott@Rockstomper 08-27-2002, 08:32 AM Kali will (or at least legally can) hassle you for intake mods not covered by a CARB EO# because the intake is part of the emissions control system.
Believe it or not, the tires and rearend ratio are also part of the same--bigger tires and/or lower gears change the design parameters of the engine/tranny, changing the emissions output. So legally, you can't change that either. At least not without an EO#.
Sounds to me like you got a really cool cop, who more wanted to make sure you *didn't* get busted by some of his less-cool buddies, than who wanted to bust you.
Incidentally, I had a little "chat" with a Colorado State Patrol officer a few weeks back, about me driving the Mantis (http://www.rockstomper.com right on the cover, if you don't know what I'm talking about) on the street... his biggest concern was "are these tires DOT approved?". I love Colorado. :)
I've searched through the California laws on it, and have basically concluded that it was so far beyond stupid of me to drive the Mantis around the block at my inlaws' house in LA, I can't believe I did it twice. :)
Desertoy, I don't have the link any more, but would you mind posting the Cali Motor Vehicle Code link?
mtadams 08-27-2002, 08:35 AM Hey desertPOS... put on some removable mega-mudflaps. That seems to keep the police up here in Northern Cal pretty happy (plus it hides just how big the lift is, etc). And fix the tail light so they don't have anything to pull you over for if they see you from behind..

Guess you got lucky and he didn't ask specifically about the wheels. (when I'm sure he meant the combination)
Rules to follow to not get pulled over:
Keep your rig clean
Run Mudflaps
parking/turn/brake lights all functional and no broken lenses
Avoid lots of dents, etc.
I haven't had a problem getting pulled over, but cop friends have told me if you keep you do the above you reduce your risk of a pullover since it shows you care about your vehicle and are responsible.

Absolutely! We had a couple of guys around here who were really good friends & both had lifted trucks. The one guy could never understand why the cops "picked on" him, but the other never got a ticket. Simple. Guy #2 would be courteous to the cops. Guy #1 would lecture them on why lift laws suck. After awhile, guy #1 is running around on 4" lift with 35's while guy #2 is still on 40's with 10" of lift & never getting tickets.

no matter how well you blow a cop he can and will ticket you
so why get on your knees in the first place
learn the rules better then they, and tell them to ram their BS
nothing more invigorating then having a DOT inspector say 'you can go now'
after a cop has mouthed off about how many tickets he is gonna write on your ride
then listening as the DOT tries to explain to the cop that it has been previously inspected and there is nothing worn out to ticket
I pulled up to ask him where all the tickets are to rub it in some
lifted isnt illegal until you get freaking HUGE in a full size truck
a jeep that is rated lightwieght will have troubles there but you guys go so far beyond what came factory you should be pursueing home built regi anyway
desertPOS 08-28-2002, 12:24 AM yeah, cop was a senior officer, and was pretty cool about it, so I thought I might as well ask him questions while he was there. He didn't necessarily say MY intake had a problem, didn't even look at it, said he didn't feel like doing any inspections that night.
Thanks for the DMV link and Scott, yeah I've seen your mantis, I was on the hammers friday morning before the 4runner jambo. Didn't drive it, just there watching and taking some pictures for my photo class. Got some good b&w prints of your rig btw. And yeah, when getting pulled over just put your attitude or any problem you may have aside for the moment and be polite. If you mouth off and get a ticket, it's only hurting yourself, he doesn't care if you have to pay a ticket or not.
AGGIECJ-7 08-28-2002, 12:36 AM why is it illegal for you to run without shocks....i personally prefer no shocks on my jeep....flexes better and rides almost as good as a kadillak.

Hypoid Drive 08-28-2002, 10:26 AM I want to clear up a few things for the guys from NC . There are no lift laws per se . There is one referenced for no more than 6" over OEM height. But.....there is an exception and that is a multipassenger vehicle that is intended for occasional offroad use. There is absoulutly no way to derive being issued a ticket for over height, that is applicable to CMV only those with 26001 and greater GVWR. Dont let them pressure you into believeing that it is a sobriety check thats bogus , its is just a reason legitimly(reasonable suspicion) to stop you to see what can be found wrong. When is the last time you drove a lifted truck that didnt wander a little. the reason that and inspection cost more than the initial 9.25 is that you are being emmision checked and window tint checked . On the emission notr there are exemptions to it such as the year of vehicle and milage over 100,000 you can get exempt waivers. You want to know how I know all of this and its accuracy its because I am a law enforcement officer for the state that specializes with CMV's for obvious reason I cant go into detail any further cause this info in the wrong hands can cause me a problem, I just want to help and I am less than 30 years old it has nothing to do with age just wheather your incompetant a dick or both which most are . If I can help any further feel free to contact me :flipoff2:
whitebrowithafro 08-28-2002, 11:28 AM Its kind of funny that this all happened because I was sweating a cop that was right behind me at a light (www.rockrawler.com) and he just flipped a u-turn and took off. I couldn't believe it! I have no mudflaps, 38's, 1 tons, and a flatbed. So Cal, depending on where you live, is pretty cool about modified trucks, I think. There are so many tubed out pre-runners, 12"lift excursions with 42's, etc. That they couldn't possibly pull over every damn vehicle on the road. So I guess you are right about the "keeping your truck clean looking" thing, cause cops will just envy you, instead of thinking your truck is a POS.

Joe,
This prevents folks from cutting out the TREAD WEAR bars! Yes, some poor bastard had done that in the past, so this lets the cop bust them for messing around. No cop would write someone up for tire sipping, nor would they mess with reasonable tread cutting.

Oh and Scott if the beadlocks are designated for off-road use only, it isn't a good Idea to run em on the street (liability wise). After much searching through the DOT code, and the NCDOT code thats the only thing I could come up with.

(2) Tire rims and wheel discs shall have no visible cracks, elongated bolt holes, or indications of repair by welding. In addition, the lateral and radial runout of each rim bead area shall not exceed one-eighth of an inch of total indicated runout.

I beleive that, technically, the welding would make them illegal in Washington State. Do I Win???
i find it interesting that you get pulled over for being to tall with only 5 inches of lift.
Here in australia you cannot modify any steering component (histeer is illegal) you can lif your truck 2 inch body and suspension 1/3 the original suspesion travel (bump stop to bump stop at ride height) and you can go an inch higher and wider on rims and tyres, yeap our laws suck and i got fawked over hard when i had a cruiser with a SOA, 3 inch springs and a 3 inch body.
apparrantly it was lifted and too tall

I'd say no. That tells me that you cannot run damaged or broken wheels, doesn't say anything about beadlocks.

Since rim shells are welded to the centers... I don't think so.
You do get props for finding the closest thing I've seen to a beadlock law, though... if you'll mail me a copy of it, or send me a link to where to find it, I'll find something cool to send ya.
I am kinda curious, though... if I can run up to just under 1/8" TIR on a rim, does the Washington Highway Patrol carry a dial indicator to check? :)
Magoo 08-31-2002, 12:14 PM I was thinking the same thing Scott...
I got pulled over in my car twice last week. Once for doing 40 in a 25 in a school zone (9 o'clock at night), and once on the freeway-for plastic license plate covers! Tell me how can you see those from a quarter mile away! In both cases I didn't get a ticket, I love my job (sometimes).
I haven't been pulled over in my truck at all this summer, no mirrors other than the rearview (WA requires two), no tabs since July (my buddy has been driving it and said he would pay for them) and my exhaust is a little loud (2.5 cherry bombs w/echo cans-on it when I bought it).
Cops are busy bustin' the rice burners while I just drive on by :D

I suspect the welding refers to welds other the required during manufacture, but who knows what a lawyer/politician has/had in mind. I also think that as long as they did not cause a problem, one would never be stopped for running them. But if for some reaso one were to loose it "locK' at hiway speed an result in accident that seriously injured or killed someone it may well be a differant story, or if there were to be a lot of failures they might use this law to declare them illegal for hiway use. 5.NOT REGISTERED AS A TRUCK. = THE TOP AND DOORS OFF
A "VW" Bug, Convertible can take the "top-off" and get no ticket.
A "1955" T Bird has a removeable top. =no ticket.
A "jeep" cj has a hard-top/removealbe. =no ticket.
A "jeep" has removeable doors. =no ticket
A"VW" "THING" has removeable doors. =no ticket
Also, a CJ5,6,7,8 are registered as a car. (correct me if I'm wrong) because I DO KNOW this, I don't pay a "commercial"

so, with this in mind, why would the CHP cite you for running

THINK ABOUT TONITE" then I added, "How about you ask* me
to turn it off, and I will glady do it" he allowed me the later,
then left.

(correct me if I'm wrong) because I DO KNOW this, I don't pay a "commercial"
rate for my jeep, and I don't pay a weight-fee for same rig.
so, with this in mind, why would the CHP cite you for running
without a top, and with 1/2 doors. do they write tickets for
YJ's without tops, running their OEM half doors-? rant-off now.
you are totally correct for the "proper attitiude" with Law enforcement.
I only once** gave a cop a big shit-fit for something.
We were parked at Chico High. cruise-night on a weekend.
my radio in the truck was on. not loud, but on. cop stops,
gets out, yells, "whose truck-?" I reply, "mine" he says, "you
better turn that damn radio off before I tear it out of the dash"
I get in his face, and YELL, "GO RIGHT AHEAD, AND TEAR THE
FUCKING THING OUT THEN" And next week, when YOU AND I
ARE IN COURT, AND I'M TRYING TO GET YOUR ASS FIRED, YOU

VERY VERY , LUCKY THAT COP DOES NOT LIVE IN YOUR NEIBIOR HOOD!
YOUR LIFE COULD/ WOULD BE ALOT DIFFERENT PROBLEY
EXAMPLE: 1. Tires Slashed, ....
2. mail stop coming to your house for no reason,
3.Water is shut off for no reason,
4.when ever you get pulled over"PossibleArmed and Dangerios,Do A FELLONY ARREST ,THIS DICK likes too MOUTH - OFF ,to the LAW, ect, ect" comes over his monitor,
ANY HOW :to get back to the 4RUNNER,
1.The way I got it exsplained
to me is that ,you kinda have a choice, "If you know how to re register a vehicle to a COMMERCIAL,
2.Insteade of havein it reg- as a sport utilitie ,"remember this was 1985, and bronco II's ,and jeeps were not I mported into this country!
3.so TOYOTA wanted to save money"to lower the cost of the 4runners"
4.I got told the only 4runners to come with back seats were the "real SR-5,4RUNNERS.
4.THE OTHER STRIPPED 4runners ,=the delux=Rn60,on the vin #'s,and Rn61then seven more digits,
GOT THERE SEATS IN THE usa dealers .
5.thats why real factory SR-5 4Runners were 12k new
6.and the DELUX 4RUNNERS ,were10K new,
7.So if you basicly want a truck 4RUNNER, take the top off, and go down to C.H.P. and get it RE CERTIFIED "as a commercial vehicle!
8.then you can pay more for yearly D.M.V. taxes ect,ect
9.I pay $26.00 a year ,for D.M.V. in cal,pr yr,for a SR-5 4RUNNER.
10.SHUT THE FAWK -UP,THIS IS A WAIST OF OUR TIME.
:flipoff2: :flipoff2: DUMB,argument.
Spank 09-02-2002, 02:44 PM A lot of people (myself included) cruise the Palm Springs/Palm Desert area en route to trails and such with questionable vehicles all the time, however I've only heard of 1-2 instances of the local cops that give a sh*t. The only complaints I've heard are from the CHP, they are the ones who really care because they just do traffic.
P&T Jeeps 09-02-2002, 03:01 PM in Louisiana you get pulled over for not having an illegal rig and being sober. what a great state, drive thru daiquiris and hard liquor, w/ windows only accessable to lifted rigs. :D

Yes by law quotas are illegal, but "job performance evalultions" aren't. If it quacks like a duck and walks like a duck, then it's a duck. No matter what you want to call it. If you don't have enough contacts with the general public you're gonna get called on the carpet. I know this and so do you. So call it what you want it's all the same in the end.:flipoff2:
