What do you do when you move to a different state? Do you have to 'declare' your guns or anything? And what happens if you have a gun that is not legal to possess is your new state? Just curious..

most peeps just move and not worry about it...

BUT, if you move to a NON NFA friendly state, you could be in serious shit if you take NFA items with you.

other than than, I really don't know...if you are moving to Kali...don't...or don't take any guns with you.

From a "free state" to another "free state", nothing, just move.

From an "occupied state" to a "free state", nothing also.

From a "free state" to an "occupied state"... don't.

If you keep something that's illegal in your new state, you could be in deep trouble--you can't move into Cali with Cali-illegal "assault weapons" or "high capacity magazines" even if they were yours before the ban but outside the state. This is part (smallish part, but everything counts) of why when I have friends hammer on me to move to Cali, I decline.

If it's legal in Washington and you're going east, just stay out of Illinois and off the east coast, and you're probably fine; if you're moving into Cali, you have to register handguns within a short timeframe. If it's Hawaii, I think you have to register everything within a short timeframe. Where are you thinking about?

When I moved from NC to CO, I did nothing. Not sure if I was supposed to or not.

Technically, I don't even know if I'm viewed as the legal owner of most of my guns. Most were inherited and I never did anything as far as transferring them or anything. The only gun I've ever purchased is my .45.

It is perfectly legal to bring off list handguns into Ca if moving into the state.

why the fuck would you have to 'transfer' your guns?

They're yours. It's nobody's business but yours, untill you do something illegal with them :homer:

If you're moving to CA - burn them all.
If you're moving anywhere else, don't worry about it.

You're not moving to CA, are you?

It's the same mentality that a house guest had a few weeks ago.

There I was, sitting at the kitchen counter, getting things ready to go shooting the next day, and all I hear is "them things have to be illegal" and "are you sure them isn't illegal?" over, and over, and over again.

All over a POS WASR and a semi-auto MAC-10 clone.

I was just looking through the Office of Attorney General "2008 Dangerous Weapons Control Law":shaking: and found out why Assault weapons are illegal in Komifornia

12275.5. (a) The Legislature hereby finds and declares that the proliferation and use of assault weapons poses a threat to the health, safety, and security of all citizens of this state.

So what is the mag capacity limit in CA? Mine is a 16 rnd mag. Is it 7? Can I just get 7 round mags or is the P250 not legal at all there?

At this point we are just thinking about it. But if I have to sell some shit I want to know well in advance..

You can still bring it with you. It is legal to bring in non rostered guns you already own. Why the hell would you want to move back here?

You might have noticed I used the word "here" which would imply to those paying extra close attention that I am "here" in Ca and instead of some craphole, say Reno, in which case I would have said, "there" dig?

I have an email into the Atty. General because NO ONE (local PD, Sheriff, Gun Store, Range) could tell me exactly. They ALL told me something different.

One guy told me I had to SEND the gun FTF to a store there from a store here, but that they would except it because it wasn't CA legal. :shaking: Another told me don't worry about it, just don't load 16 rnds when I go to the range.

Good luck with that. Try calling the DOJ BOF sometime and see how many different answers you get. You cannot bring the hi cap mags with you. You may bring non rostered pistols with you. You can modify the mags to only accept 10 round mags but there is some gray area about how permanent the mods need to be.

UPDATE:

Just got off the phone with the DOJ. The final verdict is I can keep any firearms I crrently own, I do however have to change them to 10 round mags, or get new 10 round mags.

The other thing he told me is I should bring extra P250s with me and sell them private party once I'm in Cali to make a little extra money. He said it is perfectly legal to do a private party transfer of my personal guns. He said he would even buy one from me if he hadn't just bought a P6.

So, anybody want one? You will of course have to have a 10 rnd mag.

The nice thing about that quirk in the law is that you get can more than the gun was new because it's hard to get in CA. Beware that non rostered pistols can only be sold face to face.

I'm aware. He said to copy their DL's and that should be good.

Maybe I will be able to get a P229 Stainless Elite before I leave. Yeah, right...

Uh. They still must be done at an FFL, then just ask the FFL for a copy of the DROS, all the buyers info will be on there.

Up here you can't have a more than 5 rounds capacity for a rifle or 10 rounds for pistols but all it takes to make a high capacity mag legal is to put a rivet in it to reduce the capacity. Is California something similar?

Is California something similar? You can do that and it is often done with rifle mags. I've never seen anyone do it for pistols but you could.

Do you have to have your mags inspected by someone after you move to Cali to make sure you have reduced the capacity?

Chris
06-05-2009, 05:46 PM
Do you have to have your mags inspected by someone after you move to Cali to make sure you have reduced the capacity? No, but it's a felony to transport them. How are you going to explain it if you have mags for a gun that wasn't manufactured until after 2000? If it's older than that, well, make your own call, it's not illegal to own them and you aren't under any burden of proof to show where you got them, so...
