DEAB BEAT buyer issue - need you help

Like my original post states, these are DEAD BEAT BUYERS

Kevin Blevins a.k.a. Patrick Kevin Blevins
Stacy Ann Marie Blevins
FORMERLY OF
***** Crystal Falls Drive
Sonora, Ca 95370-91**

PO Box 272
Denair, Ca 95316-0272

They have since moved '6 states over'. Their email -> rockngirl@beu.midco.net goes to a local ISP in the SW Minnisota, NE Nebraska area. Kevin used to work for Caltrans. They drove a maroon Explorer. Kevin owned an FJ40 and may have been building a truck for Stacey.
They are CROOKS that owe me $400 + all recovery fees!

Here is what occured. Last spring I advertised my Marlin Crawler (#212), Both X-fer cases, Bud-Built X member and 2 drivelines for sale on PBB and Marlins Board. Get an email from Ms Blevins that she wants it. We talk on the phone and tell her first one here with the cash gets it. She wants to mail me a MO for a deposit then pick it up on the weekend - no biggie, except the mail around here is slow. Call her back and suggest PayPal. She sends me $400 via PayPal to hold it, and will bring $400 cash. Friday night she calls and said she paid the second $400 via PayPal. Verified it was there, she and Kevin drive down to pick it up - everything is cool. I pull most of the money out of my PayPal acct for other stuff, but leave $135 in.
About a month later PayPal take$ 400 back from my account, and stated that I owe PayPal $263. Call up to find out WTF is going on. PayPal will not tell me, will not give me any info on the Blevins, and suggest that I call the local PD. Call the San Berdo Co sherrif - to them it is a civil matter and will not help me. The Sonora PD said the same thing. PayPal will only give the info to the PD. W/O any info I cannot even to to small claims court. Only thing I got was that the "credit card account they used has an issue. We have launched an investigation" - to date they will not tell me anything. PayPal then send ME to collectinos. PayPal is a joke, since they cannot contact the Belvins, they come after me..

Have made many calls to the Blevins, gotten 1 responce. They had some issues and have moved 6 states over but will make it right. Sent many emails, got a few responces. State they sent me a MO. I have NEVER recieve any MO. Stacey said she will find the reciept for proof, and I can collect from the MO vendor. Guess what - no receipt, no MO, no nothing. They will no longer respond to any emails.

So Mr/ Mrs Blevins - I warned you. I tried to work this out. I no longer care about your financial situation. If you cannot pay for something , do not buy it.

I WANT MY $400 + recovery fee's

Either send me a MO for $400 overnight UPS / Fed Ex or bring the Crawler and all the stuff back! If this is not settled by 01/01/06 every bit of info I dig up will be posted on the internet. Want to be the next Wenzle???

Here is your main problem with Paypal:

When you accepted the CC payment - you pretty much backed up and let paypal and anyone with a fraudulent credit card take a free shot at your 'sensitive zone'. I personally do not accept credit card transfers...

Paypal Policy:

User Agreement for PayPal™ Service
Receiving Payments.

5.1 Credit Card Funded Payments. The only accounts that can receive credit card funded payments are Premier and Business Accounts. Personal Accounts that receive credit card funded payments may accept the payment by upgrading to a Premier or Business Account, or they will have to deny the payment. Personal Accounts may receive non-credit card funded payments for free. By accepting a credit card payment, you agree that you are responsible for the payment if it is reversed. If such reversal occurs on a credit card funded payment made to your account, we will reverse the payment and debit your PayPal account balance to pay for the reversal unless the transaction is covered by the Seller Protection Policy. If there are insufficient funds in your PayPal balance, you agree to reimburse PayPal through other means, as described in the Payments (Sending, Receiving, and Withdrawing) Policy.

Nice try - this is NOT my fault. It is the action of Mr / Mrs Blevins. I had NO way of knowing they paid by credit card, as my acct set up to accept credit cards. Nor will Paypal give me ANY info to go after them. Paypal is as guilty as the Blevins for protecting these crooks.
Worst part is the Blevins have admitted to the issue and promised to make it right - after 8 months I have run out of patients.
So I repeat
Send me my $400 or Return Marlin Crawler #212 along with both Xfer cases, the Bud Built skid plate, both CVd drive lines

sorry pal but Pay Pal is soo bad, good luck every getting anything from them or any help what-so-ever; two years back I sold an item and after taking PayPal for it ended up 1 yr later with $1400 out due to "policy", having received a fraudulent payment and so many emails to them that I just gave up. It is impossible in my experience to get your money back and in my case I refunded the purchase after learning it was bad and 40 days later they took the money again. You can't sue them and in my experience there is nothing you can do.

Paypal collections doesn't mean much. As long as you had the money OUT of that paypal account, they're the ones that get stiffed in this - not you. Just don't use that account any more. From what I'm told, they can try to come after you, but as THEY accepted a stolen credit card (likely) it's their issue to eat.

You can proceed to small claims. Simply bring proof that paypal yanked money from your account. I'd also file a police report locally for theft - simply tell them it's a stolen credit card (even if you dont know). You take that local report and fax it over to the PD in the buyers area...

You can get an easy civil judgement locally, but good luck collecting.

Initially I ran my business thru PayPal. They are criminals in every sense of the word.
The whistleblower threads on www.nopaypal.com are absolutely true. They tried most of those scams on me.

The key to remember here is that PayPal is not a bank. They'd like you to think they are but they are nothing more than a privately held money market fund. As such they are under no federal rules regarding how they dispense your funds.

The 80 page legalese Terms of Service you agree to completely absolves PayPal of any wrong doing no matter what they do to you.

BlueCoyote3, what you need to do is go down to the small claims court and file a suit and subpoena PayPal for the information.
Having faught these battles myself I can tell you that you are pissing up a rope.
Yes, you can eventually get a judgement against these people, however collecting it's a whole 'nother matter. The time and energy you will spend getting that judgement is far out of proportion to the measly $400 you'll get it for.
The law provides very little in the way of compensation for this and your recovery fees, though you can get your legal filing fees paid.

Good luck man. If I were you, I'd chalk this up to a hard lesson learned and move on with life and don't make this mistake again.

As for PP - cannot comment on actions with them right now .......
As for the Blevins - once I get a current address on them, SC is an option.

Fairfield,CA

Police nab alleged multistate thief

By Audrey Wong
FAIRFIELD,CA - Patrick Blevins was on the lam for nearly four months. During his flight, Blevins allegedly burglarized and stole cars from the Bay Area to Oregon, authorities say.

Blevin's fugitive days ended early Wednesday when Solano County District Attorney's Office investigators and other peace officers tracked Blevins to a home off Cement Hill Road.

Fairfield Officers surrounded the home in the 2800 block of Bay Tree Drive around 2 a.m. The suspect tried to run out the back door but an officer grabbed him, said Bob Farmer, a Solano County District Attorney investigator.

Blevins and the officer allegedly scuffled, then Blevins broke free and dashed north on Bay Tree Drive, headed to Eucalyptus Court then hopped through back yards to Banyan Court, Farmer said Thursday.

Blevins allegedly kicked in the side door of a garage and scurried up the rafters where officers found him trying to hide, Farmer said.

The suspect has a methaphetamine habit, which may have fueled his late night and alleged illegal activities, Farmer said.

The Napa County native had arrest warrants from Solano, Napa and Contra Costa counties for charges such as identity theft, possessing stolen property, auto theft, burglary and having and selling drugs.

Authorities started pursuing Blevins in July after they discovered a van full of stolen items in Napa County. The van was reported stolen from Vacaville and bore a license plate also taken from Vacaville, Farmer said. Inside the vehicle were credit cards, check books and drivers licenses of 12 Solano County residents. Blevins may not have used the personal identification but may have sold the items to identity thieves, Farmer said.

Police looked for Blevins at his brother's house in Klamath Falls, Ore., in August. Blevins eluded authorities but investigators found his female companion who had warrants for identity theft.

Inside the brother's house police found property stolen from automobiles in southeast Oregon, Farmer said. Following a hunch, in September investigators searched for Blevins in the mountains of eastern Oregon. They found Blevins driving a stolen pickup truck with stolen license plates on it. Authorities tried to box him in but Blevins fled to the forest. Police learned the vehicle was reported stolen from Vacaville and the plates from Davis. Inside the vehicle were Palm Pilots, laptop computers and other gadgets tracked to owners in Oregon.

Blevins was taking the electronic items and selling them to support his drug habit, Farmer said.

Authorities continued scouring Oregon for Blevins, who was going between the two states and allegedly committing crimes along the way. In October they received a tip he returned to Fairfield,CA. and befriended a resident of the Bay Tree Drive Home. He told them his name was George Cartaker, Farmer said.

Fairfield police, California Highway Patrol vehicle theft investigators, Napa County Sheriff's deputies, a Napa police sergeant and U.S. Marshals helped apprehend Blevins.

I think I saved all the important info on them that might help you.

All baniking institutions have that right..........If you take a bad MO, your bank funds it........later finds out its bogus.........they take the money out of your account..........Paypal is no different........Some of you guys really need to wake up.... I have done thousands of business with paypal, it is still safer than checks or mo's.......but doing business anywhere in any form has its risks.

Dude I hope you get your junk back!

Sooner or later they will surface.

Memorial Day weekend in coming up - and someone somewhere will see them.
The crawler is #212.

My "$25 information fee" offer for current info still stands payable in your choice of gift card (Starbucks, Home Depot, etc). Alll the info so far was on where they used to live. Nothing on their current location (midwest some place)

This offer is for anyone that gives me the info - you can either post here or PM if you want to keep your ID private

Same guy - in fact he even mentioned that he bought a bad azzed 44 / 60 axle for Stacy's Cruiser.

Other stuff that I have dug up - Kevin / Stacy used to own an off road shop / Tranny Shop in Nor Cal - Sierra Offroad - no longer in business...

Last email from them came from an ISP ( midco.net) in the mid-west.
Last responce on the Marlin BBS came from a ISP in West Virgina
They are/were members here on Pirate, Marlin, Colorado KF, NorCal Big Dawgs - all under the same name - Crawlerfj40.
Still have some more places to look

So now the mission is to recover monies for Marlin Crawler #212 AND the monies for the axle that Nor Cal Wheelin sold them.
