Bad Buyer!! Broke_okie_Ty PLEASE READ!!

To start off... about a month ago I bought an 89 xtra cab to swap the drivetrain into my buggy... so after swapping the drivetrain i posted the rest up for sale /forum/misc-stuff-sale/565673-1989-toyota-4x4-part-out-whole.html
Tyler AKA Broke_okie_Ty called me on the phone interested of buying the truck.... After talking with him on the phone i found out he had some parts that i needed.... Said he had what he "thought" was a w56 with a top shift t case....

He went to pull a few days later and saw that it was a forward shift t case but i said whatever and told him I would trade him the truck for 300$, tranny and tcase, did not want the title, and i keeping the ifs steering box on the truck.... He said sure he even had a ifs box that he would bring up and give to me so i could leave the one on the truck.... Told him to come up whenever he got a chance...

Ended up coming up to vacaville from Fresno on the 14 of april.... when he got to the house said he accidently left the ifs steering box at home BUT said he would ship it to me... Also said this in front of 5 of my friends.... got the truck all loaded up and went to pay me.... Started counting the money and handed me 400$... I said whoa we agreed on 300$ and that is to much so here and GAVE HIM BACK THE 100$ and told him to just ship me the box and it will be fine... we unloaded the tranny and t case and i noticed it was a g52 NOT a w56 and asked him about it... he said thats what he thought a w56 was because ALL g52's are top shift Tcase... Chad Romine aka Fenderbmxer86 the tranny guru corrected him and said it was a g52.... didn't really care because i was plannin on selling the tranny anyways so i said whatever... gave him directions back home and he was on his way....

He called me a few days later and said he needed the title.... i said ok and told him to pm me his address.... He did so a few days later and i told him as soon as i got the steering box i would send him the title.... Didn't hear back so i called him 3 times last week and sent him 2 pm's... got a pm back that said as stated....

hey Taylor, i'm haveing a problem with this arrangement. i gave you $300 cash and a transmission for the truck, correct. that tranny and TC was worth $200. $300 + tranny = $500. i thought the deal was i was going to give you $400 and a gear box for the truck, then we were going to swap trannies straight across. i came home with just a truck. why am i giving you another $100 in gearbox parts plus the money to ship it, for a truck with no motor or anything. that dosent add up to me. as far as i'm concerned we are square, i just wanted the title because it would make things a little easier. you can call me if you want but thats where i stand on the subject.

Called him about 3 hours ago and the argument ended with him straight up telling me he IS NOT going to send me the box or any money.... What should i do??

I would have either pulled the box off, or told him to leave empty handed, or took the $100 extra for the box.


don't let people get over on you, he did and many will if you let them.

no it's not ok or right for him to do this,

post up in chit chat for revenge, about only thing that might help, 1 zillon calls to his house might make up for your loss

Thanks.... Yeah i guess i'm to trust worthy with people that i meet and ACT the same way.... And to top it off i had to remove his name from the bad seller/buyers list for some reason...

You do have some recourse, but with all things involving the government it will take time and it won't be easy. You can file the "proper" forms for small claims court. Luckily enough you are both in CA, so this website should help with all the forms and questions:

But then you have to prove the case, so keep all his emails as proof he went back on a verbal agreement. At least he will have to drive the 160 some odd miles to appear in court.

yeah it would be pretty stupid for him to even make the trip....

a while ago my buddy sold a jeep xj to someone on payments. the guy quit paying so i grabbed my truck and flatbed trailer and we drove by the guys house. jeep was sitting there so we stopped down the street and called the police and told them we were repoing it since he stopped paying. they showed up and we loaded the jeep. nothing the buyer could do. we left with the jeep. funny thing is my buddy resold it to someone else on payments. same thing happened again. but if hes anywhere near you and its in haul-able condition. just go get that shit back. but call the police and let them know. that way you aren't trespassing and don't get arrested for what looks like you stealing something. give them a heads up and usually they are ok with that and will even come out to make sure there are no issues.
