Definitely sounds like the McMellons want their own private creek access/OHV park. I'm sure they have and will stay ONLY on their own property when down at the creek, not the BLM, NID or other neighbor's land. Riiiiiiiight...?

I've been reading some more laws here and I found something VERY interesting.

According to current law, if the Army Corps of Engineers can issue a Section 404 permit violation for digging in the river channel, then the waterway is indeeed navigable as a 404 violation only covers "navigable" waterways.

Last chance to step up. We, here, never wanted this. We have tried over the past several years to inform you of the consequences of your actions. You thought we were blowing smoke. Guess what, we ain't.

We, here, never wanted this. BUT, a line has to be drawn and unfortunately it seems that it will be here. While the civil side of all of this is the most brutal, I KNOW that those who are here will look past this in order to preserve your property and still get a precedent on issues like these.

Property rights carry alot of weight on this forum and whether you believe it or not, we on this forum will do everything we can to preserve those rights.

For instance, if you DO decide to work with us, I can gauranDAMNtee you that there WILL be people from this forum who WILL help you put up a fence to protect your property. We WILL either drive out or convert those who are now causing the problems.

I would prefer you talk to Bebe as she is closer, but I will stand as I really have no dog in this hunt do to a 16+ hour drive to get there. There are options availible in this, BUT this is your choice.
