Since the assertion of providing "false information" made above appears to be pointed in my direction and would require using much more granularity and specificity to refute, likely triggering the "personal attack ban clause", I will not go there. What we know today as the OHMVR is a result of a single visionary State Assembly Bill and the subsequent evolution of it. This evolution came and continues to come in the form of legislative actions, both Assembly and Senate bills.

“Ch. 181671, AB 2342, Chappie-Z’berg - Chappie-Z’berg Off-Highway Motor Vehicle Law of 1971” set the stage for a 41 year old program and its feeder mechanisms that are subject to more legislative actions.

Like it or not, none of it is constitutionally blessed by “we the people”, hence it is subject to change without our vote and even dissolution.

Who to Call

There are 3 members of the Senate Budget Sub Committee that will vote tomorrow, Wednesday, May 23, to take OHV Trust Fund money and transfer it to state parks.

Senator Joe Simitian (D-Santa Clara) will vote to transfer the money.

Senator Jean Fuller (R-Kern County) will vote no.

The deciding vote is Senator Alan Lowenthal (D-Long Beach).

We need all off-roaders in the L.A. Basin to call his district office and urge him to vote NO!

Senators Simitian and Evans want to take OHV Trust Funds to prop up State Parks. The real person behind this problem in the first place is State Parks Director Ruth Coleman!

Tell State Parks; "Don't Take Our OHV Trust Funds". Ruth Coleman hasn't exhibited the leadership necessary to save State Parks from closures, she needs to step down and let someone better take over. Instead of taking funds from our OHV Trust Fund, State Parks needs to look at their issues and solve their own problems without hurting the OHV program.

Tell Director Ruth Coleman to step down and call her bosses, Secretary Laird and Governor Brown as well!

Good point as they want money any way they can get it.

But keep the main point here. "Trust"

Dear; Joe Simitian

I wanted to take this time to point out that funding for state parks is critical, but so is maintaining the public’s trust. By taking OHV trust money and using for state parks you are breaking that trust.
I voted for the $20 fee to add to my vehicle registration last year, are you saying that money too ( if it had passed) would later been reallocated to fund something else? People need to believe our government official will stay true and not break the public's trust. Please reconsider you current action on OHV trust monies.

Even ballot measures/propositions actually voted upon by “we the people” get partially or fully suspended as witnessed by Prop 42. Approved in March 2002, this provision became permanent and added to the State Constitution only to receive full suspension in 2005.

Who suspended it? Was it the Court or the legislature?

This is the response I got from Ruth Coleman's office after sending an e-mail:

Hello,

Thanks you for your note expressing concerns related to State Parks Off-Highway Motor Vehicle Recreation (OHMVR) Division's budget. Please be assured that I support all parts of the department, including the OHMVR Program.

The "Sustainable Parks Proposal", which proposes to redirect funding from State Park's OHMVR Program to cover the costs of State Park Units which have been identified for closure, has been proposed by Senators Joe Simitian and Noreen Evans, and not by State Parks. The Governor's Revised Budget does not propose any redirection of OHMVR Grant funding, and provides the same level of funding for the OHMVR Program as last year.

Once again, thank you for your interest and concern.

How soon Ruth Coleman forgets that Gov Brown's budget for last year has a provision to "take" $10M a year from the fuel tax account that was destined for the OHV Trust Fund. That "take" will occur EVERY year and is the focus of the potential law suit by the OHVDC.

Hey Brew, I don't recall the $ 10 million coming from the Gov's budget. If memory serves it was the trailer bill(s) from the legislature that added that amount.

Moving on to 2011-12, propositions 22 and 26 enacted in March 2010 and passed by “we the people” in November 2010 helped to shape the following "ORIGINAL proposed budget".



CALIFORNIA TRANSPORTATION FINANCING SUMMARY FISCAL YEAR 2011-12

In January of each year, the Governor presents a proposed budget to the Legislature that contains the Administration’s estimate of available revenue and a recommended expenditure plan. The California Transportation Financing package for 2011-12 outlines and charts the flow of the state’s transportation dollars based on the Governor’s Budget proposed in January 2011.

The 2011-12 Governor’s Budget proposes a $12.8 billion budget for the Department of Transportation (Caltrans). The package illustrates the flow of specific dollars from collection to distribution and includes transportation funding financed by the issuance of general obligation bonds under the Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006 (Bond Act).

The flow and proposed amounts are consistent with the Fuel Tax Swap enacted in March 2010, Propositions 22 and 26 passed by the voters in November 2010 and the Weight Fees Swap proposal from the December special session. Any subsequent changes made during the legislative process are not reflected in the proposed budget.

Legislative changes that impact transportation funding for the proposed budget year:

Fuel Tax Swap (March 2010): Eliminates sales tax on gasoline and imposes an additional 17.3 cents excise tax on gasoline. Increases sales tax on diesel fuel by 1.75 percent and decreases excise tax on diesel fuel to 13.6 cents. The rate is to be adjusted annually to maintain revenue neutrality with the increase to sales tax on diesel. This measure also increases the share of Public Transportation Account (PTA) funding to the State Transit Assistance Program (STA) to 75 percent of revenues.

Proposition 22 (November 2010): Restricts the use of fuel excise tax revenue for transportation purposes only; prohibits borrowing from fuel excise tax revenues; requires gasoline sales tax revenues (if reinstated in the future) to be used for transportation purposes only; reduces STA share of funding to 50 percent of revenues.

Proposition 26 (November 2010): Requires that any tax increases enacted by the Legislature between January 1, 2010 and November 2, 2010, be reenacted with a two-thirds vote of both houses. It also requires any future tax increases be passed with a two-thirds vote.

Weight Fees Swap (December 2010): Use weight fees to offset debt service cost or provide loans instead of the excise tax as originally intended with the Fuel Tax Swap.

Highlights of the 2011-12 proposed budget:

Motor Vehicle Fuel Account (0061)

Monies from the Diesel Fuel Tax, and Motor Vehicle Fuel Taxes on gasoline and aviation fuel, are collected and deposited in the Motor Vehicle Fuel Account.

The budget estimates that $5,533,263,000 is available in the account for distribution by law in the following manner:

It's true that none of the current fund diversions or proposals originated from the Parks Department, however Ruth Coleman is responsible for the unchecked spending that has left her department broke, resulting in the legislature trying to bail them out.

Off subject, I just discovered that I can add a signature line with my real name on it. My opinion, but it would be cool if everybody would do this. This "screen name" thing bothers me, since it probably contributes to the "hit and run" posting I see here. If I ever felt compelled to write something anonymously I would take a walk to get it out of my system...

Past President Ed Waldheim of CORVA, Past VP of the Southern District of CA4WDC, and CORVA Past President Award winner (also a spark plug with Rescue 3), Kim Carpenter are heading up to Sacramento to speak at the hearing on this latest attempt to raid our fund as I write this. Kim's husband and my VP of Land Use in the day, just about 10 days from the hospital with a life threathing illness, is at home rooting here to attend and make a plea for our Fund's survival.

Dedication for sure.

I haven't been able to locate Gov. Browns 2011-2012 revised budget to confirm who is responsible for the "take" of $10M. But, I will give him the credit as he signed the budget

And now, back to watching the Senate Sub Committee #2 meeting.
