CBD Lawsuit - Notice of Intent
Last week the CDB and friends submitted to Dept of Interior a 60-day Notice of Intent to Sue. This NOI effectively challenges the Biological Opinions for every desert management plan adopted by BLM, except for the ISDRA RAMP.
That means the status of access to the southern California deserts appears to be headed to the courts. This suit has potential implications that extend past southern California. CBD has not posted a notice to their web site. However, this is a real issue....

Damn, so The Suckling and Patterson lied to me!
(I know this is serious, but I couldn't resist that one.)

Thanks for posting this up John.
Is this essentially the same as the previous (1999?) suit? What this proves is the CBD and friends are HUGE wastes of money. The BLM has spent millions to get these BO's...many of which arose out of the first suit. The end result - they dont like the result so they sue to start the whole process over. This time around they have Jeff Ardohl on their side, ex BLM employee who knows a lot about the BO's. |

Don't have specifics other that it appears to be centered around the "process" and lack of adequate analysis to protect the threatened and endangered species in the desert areas.
I have a copy being sent to me as soon as Kinko's figures out how to scan 38 pages into one pdf rather than individual jpegs.... (Competent service is hard to get these days.....) When it is available, it will be posted at http://www.muirnet.net for intersted parties.
