Just one example is that of the American Sand Association ("ASA"). Long story short, I warned them in about 2001 or so that the legal approach was a looser and I had had conversations with Richard Pombo and staff about a legislative approach. Given that Pombo was the Chair of the House Interior Committee in the day, his staff assured me if the sand community would support a legislative approach, the Chair would have it rammed through his key committee in a matter of a couple of weeks. The also had White House support.
Nonetheless, the leadership of ASA decided to continue down the legal path and nearly 10 years later, the closures of the ISDRA are no more open today than when they were closed by the lawsuit.
