problems with dmv please help

i have a friend who has just got a mog from germany the sellers in germany said they sell alot of mogs to california and registering would not be a problem , well he got a letter from the dmv saying it can not be registered and possible persuance could lead to a fine or even his vehicle taken away from him
does anybody know if this true what the dmv are saying?
has anybody got a mog and had the same roblems ?
does anybody know of a way it can be legally registered ?
your help will be greatly appreciated

As long as he has the forms (DOT HS-7 & EPA 3520-1) which should have been required to properly clear US customs, a copy of the Fahrzeugbrief (German registration) which Ziggy usually sends and a valid bill of sale, a 75 416 is drop-dead easy. Somebody at the CA DMV is being a dick.

To the letter of the law CA DMV is correct that a 1975 USED DIRECT IMPORT Vehicle must be EPA certified to be put on the road in the state of CA. And Yes, they are being dicks about it....but their basis of law is their.

The way the CA statutes read is the 416 Doka in question is considered a Medium Duty Truck. Furthermore as the owner submitted his foreign documents title/importation it would be rather simple for them to determine that the truck is a "Used Direct Import." Put the two together and you have a vehicle that to the letter of the law is not supposed to go on the road without a CA EPA certification. (Toss that idea out as the only 2 Labs in the state would like somewhere between 8K-10K for this test.)

The owner made the following huge mistakes:

#1 - Relying on their information from the company supplying the vehicle. (CU is not at fault as you cannot expect them to know the laws in 50+ states plus their own country.)
#2 - Not researching the process prior to starting the process. IE do not let CA DMV be the one to decide what you do and do not need. 1 call to ARB prior to the current situation and the customer would have been told what he has know learned. (Anonymous call....)
#3 - Hate to say it guys but a U.S. based importer probably would have handled the importation/registration on a consulting basis (very reasonable) as well as given the buyer access to cheaper freight, customs brokerage, and most importantly no DMV hassles.

The damage is done, the truck has been flagged in the CA system, and the owner will have a hell of a time jumping through hoops trying to go around the CA regs.

Yes the same truck purchased from out of state would have no problems. Yes diesels are smog exempt in CA. (Currently) Yes numerous Unimogs that are a lot newer are currently registered in CA. Yes it's unfair. Yes it doesn't make sense, and yes it is California.

hers what happened just lately, after the dmv took all the paper work (import fees ,registration fees , transfer fees , doc fees etc) costing $880.00 paid to the dmv they only send back the tittle and a note saying all fees basically are non refundable , whats up with that ?

Sounds like they titled with verbal biatching but when it cames right down to it the paper work was actually all in order so they had to title it. $880 is the tax?

So you have a title now. Any special note on the title about AG orrr? If not...... then take the title to A DIFFERENT DMV register it. Make sure you get Ins. first.
