Dad not a suspect?
So when you find three kids and their mom all dead with multiple gunshot wounds and the dad with a gunshot to the LEG all sitting in an SUV...with a gun found at the scene...how is the dad not a suspect?
The facts: Kids: Multiple gun shot wounds. Dead Mom: Dead. Dad: Gun shot to the leg. SUV: Parked on a service road to a cell phone tower. Family: Appeared to all to be a great loving family. Gun: Found at the scene. If this happened in the middle of the night, then why the fuck would someone not kill the dad, and why would they leave a gun at the scene when they easily got away? http://www.foxnews.com/story/0,2933,282873,00.html

can't they tell how far away someone was from a gun judging by size of wound and gunpowder residue
 that would be my guess

I bet he is still a suspect internally. The department does not want to risk a lawsuit if he is innocent.
It is just how things work these days.

wound trajectory, powder burn, powder impregnation and residue can be a VERY quick rule out.

I was gonna say...what were they doing on a cell site service road? That's where I work, that's my road(the ones in CA and NV anyway). I could imagine coming across this guy in the middle of the night on my way down a mountain.
