Current tellico summary?
Ok, so here's what I gather from reading the posts on here. Please let me know what's going on and if I am right.
TU gave up and their case is over. Forrest service is going to make a decision mid September. (what was the decision?) Are trails like lower 2 open or going to be open very soon? If TU gave up, then why hasn't everything been returned to normal?

TU had a case against the FS, the FS made trail closures, TU dropped the lawsuit
SFWDA opened a lawsuit against the FS, the FS is working to come to a resolution to reopen/reroute/permanently close/properly maintain trails so SFWDA dropped their lawsuit against them Now we are in a holding pattern, the FS said they will have 5 proposals out by the end of the year and want public opinions on each of them. Thats the gist of it anyways... |

The Southern Enviromental Law Center suit filed along with TU/PEER/Wildsouth was the first legal aggression and what started the whole mess.
The BRC/UFWDA/SFWDA suit was in response to the SELC suit and served as a means to intervene to insure that the FS was not simply bullied into the proposed trail closures by an uncontested SELC. SELC started a fight with the Forest Service. But after the good guys intervened, they withdrew their initial suit and "aligned themselves" with the FS in defense against the good guys. A thinly veiled tactic to paint the OHV crowd as the "opposition" and the SELC as the "defender of the Forest Service". Weak sauce. BRC/UFWDA/SFWDA withdrew their lawsuit as its original intent had already been served. SELC had dropped their initial suit and the FS was revising their proposal. However, the suit was withdrawn without prejudice, meaning it could be revived at any point. Nobody has given up. Least of all TU. Despite some of their membership resigning after learning of this particular campaign to close OHV trails, they still have a lot of $$$ and corporate sponsorship. These include Cabelas, UnderArmour, Barnes & Noble and LL Bean in case you were wondering where NOT to spend your holiday dollars. There are some trails closed now. Those are listed elsewhere. But the ill-conceived "winter closure" is coming up and all trails will be closed from Jan-March. New proposal/EA may be out in January 09. Last edited by GSW; 11-29-2008 at 12:21 PM. |
