Mystery....no LC content long.

I recently purchased about 7 yrs. worh of old Toyota Trails, dating back to 1990.
Kristie and Deb were browsing them, and found a memorial half page tribute to Kimberly Anne Saunders it had no mention of how she died......

3rd District Court of Appeal

Early in the morning of October 27, 1996, Kimberly Anne Saunders "became missing" while traveling on a road between two towns in Nevada County. That afternoon, her family made a missing person report to the Nevada County Sheriff’s Department. It is alleged the Department undertook an unsuccessful search and rescue operation that concluded a mere 24 hours after the operation started and then listed Saunders as voluntarily missing, despite protestations to the contrary from her family. Saunders’s body was located 21 days later, within two miles of the road upon which she disappeared. The cause of her death is unknown.

A claim was filed against the County and denied. Plaintiffs filed a federal lawsuit 77 days before the state statute of limitations ran, but later agreed to have the case dismissed.

The plaintiff’s attorney miscalculated the running of the state statute of limitations. Plaintiffs filed this action in Nevada County on July 12, 2000, alleging causes of action for negligence and wrongful death against Nevada County and its Sheriff, Troy Arbaugh, and Assistant Sheriff, John Trauner.

The complaint alleges (1) Nevada County refused assistance from out-of-county search and rescue teams; (2) the Nevada County Sheriff failed to adequately perform search and rescue efforts; and (3) the Nevada County Sheriff did not conduct an adequate search and rescue effort because of Saunders’s gender and the fact she was not a resident of Nevada County.

The six-month statute of limitations for this action began when Nevada County denied plaintiffs’ claim on March 17, 1997. Federal law provides that "the period of limitations for any claim . . .shall be tolled while the claim is pending in federal court and for a period of 30 days after it is dismissed unless State law provides for a longer tolling period." The superior court dismissed the case and plaintiff’s appealed.

The Court of Appeal ruled that the 30 day federal statute of limitations ran, but they could have filed their suit in the time remaining to them under the state statute, i.e., the state statute was tolled during the federal case plus 30 days after the federal case was dismissed. Thus plaintiff’s had 30 days plus 77 days remaining on the state statute of limitations, but failed to file the case in that time period, and the Court upheld the dismissal. There was no equitable reasons to extend the statute simply because of attorney neglect.

I remember reading something about it. I asked a couple people if they knew anything but, never could get an answer from anyone about what happened. I seem to remember she was either found or went missing in the Georgtown area

There is LC content - she owned one and was in TOTR....

I lived down there back then. My recollection is a bit hazy, but Kimberly disappeared in the foothills near where I lived. She was a good friend of & (I believe) member of Toys on the Rocks (the Placerville Club). Her good friends, including Roberta and Danny Warden organized a search party that included TOTR and Toyotally Awesome Cruisers (the Auburn Club).

It wasn't the Georgetown area. It was in Nevada County. Without my map, I am unable to remember the town it was near - I think there was a Clamper meeting place in town.

We spent a full day walking and driving the twisting winding roads, checking the ravines and hillsides. We did not find her. She was later found close to where we had been searching.

My guess is that the 'Out of County Search and Rescue Teams' included or was her home club TOTR. I remember wondering why we got NO help from the local LEA....

I had only met her once, and she was a great gal. We did runs with the TOTR club 2 - 3 times a year.

A longtime TOTR member would be able to give you facts. It was a really sad thing, and IIRC she left a daughter behind.

the article in TT mentioned that, and that she started with a mini....just did not type that in last nite, so I guess no findings were ever resolved as to cause of death or nothin'???

1996 Was a strange weather year, not sure if they had an early storm that year or not.

I remember camping up out of Truckee in early November and getting nailed by a storm. Late 1970's. Late October??, so it can get cold... but we got a good couple of feet of snow to catch us off guard. Uh, seem to remember that season was the year when a bunch of folks on Highway 50 were killed by a massive landslide. New road was built over the top of the slide, too much earth moved to attempt any recovery of lost vehicles.

Kim's mystery

My name is Jessica Saunders. I am Kim's only child. At the time I was 10 years old, now I am 26. I myself still do not really know whatever happened. The person who started this thread is there anyway u would be able to email the paperwork that u have?? I am trying to find out myself please if anyone has any information please try and contact me. I do know this. My mother and I received a plaque for being the first two ladies to complete the Rubicon without the help of a man. Thank for keeping my mother alive

First, let me offer my condolences, I have a 9 yr. old grand daughter who is my entire world, and I know how much she loves her mom (my daughter) my heart aches just to think what it must have been like to lose your mom.

I am 1500 miles away, and bought a lot of old Toyota Trails issues on EBAY.......these are in my storage bldg. boxed up and against my wife's suggestions, not labeled....the next time I am down there I will do my best to locate that issue, as I recall it was a small ad type post. With not any info other than what I posted.

Hi jessica, you probably don't remember me. I lived across the street from you and your mom when that happened. you were over at the house many times playing with my girlfriends daughter. My girlfriend and I wheeled with her several times. We also spent some time up at your grandpa's cabin wheeling and having fun. Just wanted to say your mom was a great lady and wheeled as good or better then most guys!! Did your uncle save her cruiser for you? I know he was talking about it

No the cruiser got sold behind my back... Very upsetting to see it drive through town and I didn't know who it was

Ok I think I remember...no offense...but a lot of the ladies on tht bloc had boyfriends if my memory is correct...I hope I'm thinkin of the right house..

And for anyone interested in seeing the piece I have been informed it is in the jan feb issue of 97....
