I called a local ambulance chaser. As expected, he told me that since there was no injury and the value of the vehicle was low, there was no profit for him to get involved. He suggested that I take Enterprise and the driver to small claims court.

They live for this stuff.

They'll hit the print button and out will come all the paperwork for all the motions to go after the driver, the rental company, and everyone even remotely connected. Whoever has insurance will pay up.

Act fast.

Sadly this is the best and only way to handle this

I got rear ended by someone with a suspended DL and outstanding warrants for FTAs

They were driving a vehicle registered to someone else that was actually insured

Damage to my vehicle , a 73 Bronco was about $2500 for trailer hitch, bumper , gas tank, skid plate , tailgate, tweaked frame horns

The ins co offered me $550 and refused to budge

All the stress of this caused me a sore neck and back , treatment of which was provided at no cost to me by a doc the lawyer I called works with

The scum at the ins co who refused to pay me the actual damages eventually paid for the damages and lawyer fees and doc bills

Pay local ambulance chaser to draft of a letter and send it to enterprise for damages, the threat might be goid enough to get some cash and them off your back.

Dear Sir/Madam:
Our review indicates that you are responsible for the damages to our vehicle.
Enclosed please find documentation to support our claim. Please review this information and remit
payment in full to the address above. Please include our claim number on your payment. If you
prefer you may also pay the amount due using a debit card, credit card or directly from your bank
account at: http://www.claimtopay.com.
If you have reported this claim to your insurance and / or credit card company, please contact our
office with the claim information.
This is the end of the deal that your insurance company should be dealing with. While you don't have any coverage on your vehicle, they are the ones that will pay out this claim - or fight it as they deem fit.

Yes, what I said previously because I did just that years ago.....And the company agent cut me a check on spot as we appeared before the judge..The woman drive may not respond to the summons, but the rental company will show up to avoid the hassles of judgements against them...File the claim now...

Going the small claims route. I don't expect to see a penny, but at least I hope to bother the woman who hit me.

If liability insurance is required by your state for registration then Enterprise is required to have insurance without regard to the drivers' insurance. They are self insured so it will be a battle obviously.

Seems like small claims is a slam dunk. At least when it comes to winning a judgement. Collecting is a separate matter . . .
