Yeah, it's insane and it doesn't have to even be someone involved to call the police for it to happen. Some counties are fucking horrible about it as well.All I will say is Virginia is completely fucked when it comes to "domestic violence". Pretty much bumping into your significant other will get you that charge and if it's against a female, you can bet you will be convicted. If that person happens to live with you or you have a child in common or is otherwise "family", then you get the violence against a family member bit and can no longer own firearms. I know a bunch of people, men and women, who have caught that shit and most of the people I know think it's just an excuse to push the anti-gun thing.
Buddy of mine a couple years ago got in an argument with his gf. I was there, neighbor called Henrico PD. They showed up, she was adamant about it just being an argument and no one had touched anyone. I told them the same thing and my friend left in handcuffs anyway. He spent thousands on an attorney to get the charges dropped because Henrico charged him even without her accusing him of anything.
Henrico does the same shit with assault. Former coworker and friend was a good dude, his ex is complete white trash but they have kids together. He's never missed a child support payment. Went to pay her one day and her bf at the time ran his mouth about him needing to pay sooner. Lost his temper and decked the guy. Neighbor saw it and called Henrico PD. The bf told them he didn't want to press charges and that no one in the house called them. They charged my friend anyway and the county pursued it. Ended up pleading on it because he couldn't afford an attorney and the judge gave him like 6 months of weekend jail over it.
The legal system in this state sucks no matter which party is controlling the local gov.
